CONDITIONS OF APPROVAL <br /> MS-92-170 <br /> EIGHT MILE RANCH <br /> Unless otherwise specified, all Conditions of Approval shall be <br /> complied with prior to the approval of the Parcel Map. <br /> This approval will expire two (2) years from the date of approval <br /> unless, (1) all Conditions of Approval have been complied with, and <br /> (2) a Parcel Map has been filed with and accepted by the Surveyor's <br /> Division. <br /> Those Conditions followed by a Section Number or other Statutory <br /> Requirement are based on Ordinance Requirements. Ordinance <br /> Requirements cannot be modified. <br /> 1. DEPARTMENT OF PUBLIC WORKS: <br /> a. A Parcel Map is required. (Planning Title Section 9- <br /> 9112) <br /> b. Remainder shall be designated as "Designated Remainder" <br /> on Parcel Map. (Subdivision Map Act Section 66445) <br /> C. The Traffic Impact Mitigation Fee will be required when <br /> parcels are developed. The fee is due and payable at the <br /> time of building permit application. (The fee currently <br /> is $2 , 079. 00 per 1, 000 gross square foot of building as <br /> "Service Commercial" in the Lodi area. The fee shall be <br /> automatically adjusted July 1 of each year by the <br /> Engineering Construction Cost Index as published by the <br /> Engineering News Record. ) (Resolution R-90-304 , R-91- <br /> 1025) <br /> d. Dedication to result in a 55-foot wide right-of-way from <br /> the centerline of Lower Sacramento Road to the property <br /> line shall be required across the frontage of Parcel 1. <br /> (Planning Title Section 9-9430, 9-9431) <br /> e. The frontage improvements for Lower Sacramento Road <br /> across Parcel 1 shall be constructed in conformance with <br /> the standards for one-half of a 110-foot right-of-way <br /> expressway street. The construction of the frontage <br /> improvements will be deferred, upon execution by the <br /> owner of a Deferred Frontage and Roadway Improvement <br /> Agreement or a Secured Deferred Frontage and Roadway <br /> Improvement Agreement with a deposit equivalent to their <br /> estimated construction costs prior to approval of the <br /> Parcel Map.
