Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve the Time Extension application for approved Use Permit No. UP-95-9 based on the <br /> previously adopted Findings and subject to the previously approved Conditions of Approval <br /> contained in the staff report. <br /> Findings Adopted on August 31, 1995, for Use Permit No. UP-95-9 <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable <br /> plan adopted by the County. <br /> • This Finding can be made because the proposed use is consistent with the A/G <br /> (General Agriculture) designation of the General Plan and is permitted in the AG-40 <br /> zone subject to an approved Use Permit application. The proposed church facility <br /> presents no significant General Plan policy issues, and there are no Master, Specific, <br /> or Special Purpose Plans affecting the site. <br /> 2. Adequate utilities, roadway improvements,sanitation,water supply,drainage,and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This Finding can be made because the project site has public road frontage on Lower <br /> Sacramento Road and because all other services will be provided on the site in <br /> conformance with applicable Ordinance requirements. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This Finding can be made because the Site Plan demonstrates that all activities <br /> proposed on the property can be accommodated on the site and meet all County <br /> standards for parking, yards, and on-site services. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare <br /> or be injurious to the property or improvements of adjacent properties. <br /> • This Finding can be made because the Initial Study prepared for UP-95-9 found that <br /> the project would not result in any significant, adverse environmental impacts. <br /> 5. The use is compatible with adjoining land uses. <br /> • This Finding can be made because the Initial Study prepared for the project found <br /> that it would not be incompatible with surrounding land uses. <br /> San Joaquin County UP-95-9/Bear Creek <br /> Community Development Page 7 <br />
