Louver Sacramento Road, Lodi;APN: 058-070-23) <br /> This item was continued from the Planning Commission meeting of April 21, 2005 with the <br /> hearing closed. The continuance was to allow County Counsel time to review a legal issue and to <br /> allow the Community Development Department time to review a screening issue. <br /> I <br /> Legal Issue <br /> The Planning Commission asked County Counsel to provide information regarding a lis pendens <br /> i <br /> that has been filed by the Lodi Muslim Mosque against the Farooquia Islamic Center. County <br /> Counsel sent a memo to the Planning Commission explaining lis pendans and indicating that"the <br /> filing of the lis-pendens should not weigh for or against the Planning Commission's decision." <br /> Screening Issue <br /> The Planning Commission asked the Community Development Department to determine if a wall <br /> should be required along the southern property line of the project site. <br /> Development Title Section 9-1020.5(e), Requirements for Parking Areas, states: <br /> Unless otherwise specified, parking areas abutting a residential zone, an area shown on <br /> the General Plan for residential use, or an existing residential use, shall be screened with <br /> a solid masonry wall six(6)to seven (7)feet in height along the abutting property line, <br /> and a five (5)foot planting strip shall be installed adjacent to the wail and the parking <br /> area. <br /> The parking area along the south property line abuts a one-acre lot developed with a residence <br /> and an approximately 8-acre lot also developed with a residence. Both residences appear to be <br /> within 100 feet of the parking lot. The Community Development Department recommends that <br /> the following condition be added to the Conditions of Approval: <br /> 1.1. SCREENING: The parking area shall be screened from the property to the south by <br /> a solid masonry wall six (6) to seven (7) feet in height. (Development Title Section <br /> 1020.5[e]) <br /> The applicant concurs with this recommendation. <br /> Additional Letter <br /> A letter dated May 5, 2005 from Howard Seligman is attached. The Community Development <br /> Department has not reviewed the letter as it was received after the hearing was closed. <br />
