There is currently a.:1,213 <br /> square foot building on the parcel and 256 square feet of adjacent buildings on the <br /> parcel. The applicants are proposing a total 4,427 square feet of building space. This <br /> would be used for Retail Sales and Services: and Professional Services. <br /> The applicant initially applied for a Variance to reduce the front yard setback as well. <br /> Development Title Section 9-235.4(a)[2] states that a non-conforming structure may be <br /> added or enlarged within the yard setback as long as the building does not expand into <br /> the setback area by more than 100%. The applicant is not extending the building more <br /> k than 100%, therefore, a Variance is unnecessary for the 10 foot setback encroachment. <br /> The project is located on the west side of N. Lower Sacramento Road approximately 87 <br /> feet north of E. Augusta Street, in Woodbridge. The General Plan designation is CIC <br /> (Community Commercial) and the zoning is C-C (Community Commercial). <br /> Findings <br /> In order to approve a Variance, the Development Title Section 9-827.5 requires that the <br /> following Findings are true: <br /> 1. Special Circumstances. Because of the special circumstances applicable to <br /> the property, including size, shape, topography, location, or surroundings, the <br /> strict application of the regulation deprives the property of privileges enjoyed by <br /> the other property in the vicinity and under identical zoning classification. <br /> I <br />
