Analysis
Background
On July 21, 1994, the San Joaquin County Planning Commission approved a Use Permit application for
the Woodbridge Community Church for a 300-seat, 6,000-square-foot worship hall, a 6,000-square-foot
multi-purpose building, and a 2,500-square-foot office building. This approval required that all conditions
of approval be met and all necessary building permits be obtained within 18 months.
In November 1995, a Revisions of Approved Actions application was filed for the purposes of phasing
the project and minimizing the requirements for construction of a solid masonry wall. On February 15,
1996, the San Joaquin County Planning Commission conditionally approved the Revisions of Approved
Actions for Use Permit Application No. UP-94-9. The project was slightly modified, and this approval
was for a 300-seat, 7500-square-foot worship hall, a 6,000-square-foot multi-purpose building, and a
1,600-square-foot office. Condition No. 1.a. of this approval provided for constructing the project in three
phases, in accordance with the phasing identified on the Site Plan dated January 26, 1996. Phase I
required that all conditions of approval be complied with, all necessary building permits be issued and
remain in force; and all necessary permits from other agencies be issued and remain in force prior to
January 30, 1997. According to the schedule, Phase I was to have begun immediately and consisted of
the site grading and construction of the multi-purpose building and other related site improvements. A
grading permit was issued February 2, 1996, but the building permit was not obtained for construction of
the multi-purpose building by the required date of January 30, 1997. As a result, this condition was not
complied with, and the Use Permit approval lapsed.
Subsequently, a new application (UP-97-9) was filed for the same project that had expired. The Planning
Commission heard the application on June 15, 1998, and voted 7-0 to conditionally approve the project.
Condition No. t.b. was modified to allow additional time to commence each of the three phases. The
building permits have been issued for Phase 1. It was at that time the applicant realized Public Works
Condition No. 2.e. required a 'secured' Deferred Frontage and Roadway Improvement Agreement.
Deferred Frontage and Roadway Improvement Agreement
At the time the application was approved, the Public Works Department required that the improvements
be secured in lieu of the preparation of a traffic study. Public Works concurs that the left-tum and
acceleration lanes at the south entrance to the project site will not be required for some time. Public
Works therefore concurs with the request that the Deferred Frontage and Roadway Improvement
Agreement not be secured. The Agreement will be recorded and constitute a lien against the property.
V San Joaquin County UP-97-9\Woodbridge
Community Development Page 5
