Analysis <br /> This Minor Subdivision application, which would normally be processed under Staff Review with <br /> Notification procedures, has been referred to the Planning Commission due to the site's application <br /> history. <br /> History <br /> On January 8, 1993, the Development Services Division approved Minor Subdivision Application No. MS- <br /> 92-229 of R.E. Dondero, with Edward Steffani as the applicant, to subdivide a 550-acre parcel into four <br /> 40-acre parcels, with a fifth parcel to contain 390 acres. On January 18, 1993, the approval by staff was <br /> appealed by Steven F. Sanguinetti. After considering all written and oral testimony, the Planning <br /> Commission voted to approve the appeal and deny the Minor Subdivision based on the inability to make <br /> required Finding No. 6 regarding the project's potential to cause significant public health problems. At <br /> the hearing, the Commission made note of the fact that an existing public pistol range located southwest <br /> of the subject parcel represented a possible hazard to future residents on the subject parcel. <br /> On June 24, 1993, the Development Services Division approved Minor Subdivision Application No. MS-93- <br /> 35 of R.E. Dondero, with Edward Steffani as the applicant, to subdivide the subject parcel into a 120-acre <br /> parcel and a 430-acre parcel. The application included a request for a waiver of the Parcel Map, which <br /> was approved by the Department of Public Works. <br /> Public Health <br /> The pistol range located on the east side of Hewitt Road, southwest of the subject parcel, is still in <br /> operation at this time. Its presence is not considered a threat to the hearth or safety of future residents <br /> on the subject parcel because of the 3/4-mile distance between the range and the subject parcel. The <br /> distance between the parcel and the range has actually increased by approximately 650 feet, due to the <br /> deletion of the westerly-most parcel proposed by Minor Subdivision Application No. MS-92-229. The <br /> Safety of people on the subject parcel will not be jeopardized by the operation on the pistol range as long <br /> as the facility is property managed. <br /> Biota <br /> It was noted during the public hearing for Minor Subdivision Application No. MS-92-229 that wetlands had <br /> been identified on the site. Even though the Department of Fish and Game has not confirmed the <br /> presence of wetlands on the property, the recommended Conditions of Approval include the requirement <br /> to maintain a minimum building setback of 100 feet from any wetlands or intermittent water courses <br /> dented in the Stockton East Water District's Wetland Mitigation Report. That report was prepared by <br /> the District under the requirements of the California Environmental Quality Act (CEQA) to permit the <br /> construction of a canal through a portion of the subject parcel. <br /> San Joaquin County MS-94-10/Steffani <br /> Community Development Page 5 <br />
