CONDITIONS OF APPROVAL <br /> PA-0600011 <br /> Dondero, at al <br /> Major Subdivision Application No. PA-0600011 was approved by the San Joaquin County Planning <br /> Commission on March 16, 2006. The effective date of approval is March 26, 2006. This tentative <br /> map approval will expire on March 26, 2009, which is three years from the date of approval, unless <br /> (1) all Conditions of Approval have been complied with and (2) a Final Map has been filed with and <br /> accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be <br /> complied with prior to approval of the Final Map. Those Conditions followed by a Section Number <br /> have been identified as Ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Kathy Allen, 953-7509) <br /> a. TENTATIVE MAP: The Final Map shall substantially conform with the approved tentative map <br /> dated January 8, 2006. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be placed on the Final Map: <br /> (1) All persons purchasing lots within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniences or discomforts shall not be considered to be a nuisance. <br /> c. TRANSFER RESTRICTION/NON BUILDABLE REMAINDER: A note shall be placed on the Final <br /> Map and Notice of Major Subdivision Restriction shall be recorded concurrently with the Final Map, <br /> with a reference to the instrument number of said recorded notice, stating that: <br /> (1) Neither the home site parcels (Parcels 5 and 6) nor Parcels 1 and 3 may be voluntarily <br /> transferred separately from the other parcel; however, if an institutional lender forecloses on <br /> either parcel, either parcel may be transferred separately in accordance with the power of sale <br /> provisions contained in the deed of trust; <br /> (2) Upon repayment of the loan, the owners of the homesite parcels shall merge the homesite <br /> parcels with Parcels 1 and 3, as provided for in the Development Title, unless the owner of the <br /> homesite parcels acquired the homesite parcels through a foreclosure action, or unless the <br /> owner refinances the loan. <br /> (3) Parcels 1 and 3 shall remain non-buildable sites for primary dwelling units. <br /> (4) The above restrictions shall terminate if the subject property is reclassified to a non-agricultural <br /> zone or to an agricultural zone with a five(5) acre minimum. <br /> d. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcels 1 through 4 shall have a minimum lot width of 330 feet, measured at the front yard <br /> setback line.
