WEED CONTROL: If noxious weeds are on the site, <br /> operations shall be in accordance with instructions from <br /> the Agricultural Commissioner of San Joaquin County. <br /> (Development Title Section 9-1410 [h] ) <br /> g. LIGHTING: Any night lighting established on the <br /> property shall be arranged and controlled so as not to <br /> illuminate public rights-of-way or adjacent properties. <br /> (Development Title Section 9-1410.3 [e] ) <br /> h. HEALTH CONSIDERATION: Excavations shall not cause <br /> health or sanitary hazards and shall not create <br /> conditions which will cause the breeding or increase of <br /> mosquitos, rodents, or other pests. (Development Title <br /> Section 9-1410.3 [i] ) <br /> i. WRITTEN NOTIFICATION/IMPROVEMENT PLAN: A written <br /> notification of work schedules and an Improvement Plan <br /> shall be provided by the applicant and approved by the <br /> County prior to any grading or excavation. The <br /> Improvement Plan shall reflect all of the adopted <br /> Conditions of Approval. One (1) copy of the Improvement <br /> Plan shall be submitted to the Development Services <br /> Division for distribution to the involved County <br /> departments. A plan check fee will be required. <br /> (Development Title Section 9-1410.3 [j ] ) <br /> j . CERTIFICATION OF COMPLIANCE: At the completion of the <br /> grading, the applicant shall have a registered civil <br /> engineer or licensed land surveyor compare the <br /> excavation' s final elevations with . the approved permit. <br /> The engineer or surveyor shall submit a certified, <br /> written finding to the Development Services Division <br /> which states and documents the compliance or non- <br /> compliance of the excavation with all of the conditions <br /> of the approved permit, including documentation that <br /> fertilization has been completed per the laboratory <br /> recommendations submitted by applicant. (Development <br /> Title Section 9-1410.3 [k] ) <br /> k. PERFORMANCE GUARANTEE: To insure that the excavation is <br /> completed in conformance with the approved permit, the <br /> operator shall secure a performance bond or other <br /> financial security sufficient to cover the cost of <br /> rehabilitation of the site for agricultural use. The <br /> form or the bond or other financial security shall be <br /> found acceptable by County Counsel. (Development Title <br /> Section 9-1410.2 [m] ) <br /> 1. TOP SOIL REMOVAL: The applicant shall not be required <br /> to replace the site' s topsoil and excavated material may <br /> be removed from the site without stockpiling, following <br /> the County' s acceptance of the performance guarantee. <br />
