TOW 1%W f. WEED CONTROL: If noxious weeds are on the site, operations shall be in accordance with instructions from the Agricultural Commissioner of San Joaquin County. (Development Title Section 9-1410 [h] ) g. LIGHTING: Any night lighting established on the property shall be arranged and controlled so as not to illuminate public rights-of-way or adjacent properties. (Development Title Section 9-1410.3 [e] ) h. HEALTH CONSIDERATION: Excavations shall not cause health or sanitary hazards and shall not create conditions which will cause the breeding or increase of mosquitos, rodents, or other pests. (Development Title Section 9-1410.3 [i] ) i. WRITTEN NOTIFICATION/IMPROVEMENT PLAN: A written notification of work schedules and an Improvement Plan shall be provided by the applicant and approved by the County prior to any grading or excavation. The Improvement Plan shall reflect all of the adopted Conditions of Approval. One (1) copy of the Improvement Plan shall be submitted to the Development Services Division for distribution to the involved County departments. A plan check fee will be required. (Development Title Section 9-1410.3 [j ] ) j . CERTIFICATION OF COMPLIANCE: At the completion of the grading, the applicant shall have a registered civil engineer or licensed land surveyor compare the excavation' s final elevations with . the approved permit. The engineer or surveyor shall submit a certified, written finding to the Development Services Division which states and documents the compliance or non- compliance of the excavation with all of the conditions of the approved permit, including documentation that fertilization has been completed per the laboratory recommendations submitted by applicant. (Development Title Section 9-1410.3 [k] ) k. PERFORMANCE GUARANTEE: To insure that the excavation is completed in conformance with the approved permit, the operator shall secure a performance bond or other financial security sufficient to cover the cost of rehabilitation of the site for agricultural use. The form or the bond or other financial security shall be found acceptable by County Counsel. (Development Title Section 9-1410.2 [m] ) 1. TOP SOIL REMOVAL: The applicant shall not be required to replace the site' s topsoil and excavated material may be removed from the site without stockpiling, following the County' s acceptance of the performance guarantee.
