CONDITIONS OF APPROVAL <br /> GX-97-2 <br /> HASHEM NARAGHI <br /> Agricultural Excavation Application No. GX-97-2 was approved by the San Joaquin County <br /> Community Development Department on September 22, 1997. The effective date of approval is <br /> October 2, 1997. This approval will expire on April 3, 1999, which is 18 months from the effective <br /> date of approval, unless (1) all Conditions of Approval have been complied with and (2) all <br /> necessary permits from other agencies have been secured and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be <br /> fulfilled prior to the establishment of the use. Those Conditions followed by a Section Number <br /> have been identified as Ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Tom Gau, 468-2344) <br /> a. FINAL GRADE : The average finished grade elevation shall <br /> be no lower than 49. 1 feet. (Development Title Section <br /> 9-1410 . 3 [b] [41 ) . <br /> b. PERMIT EXPIRATION: All Conditions of Approval shall be <br /> complied with and grading shall have commenced within <br /> eighteen (18) months of the date of approval of GX-92-8 . <br /> Excavation and final rehabilitation of the site shall be <br /> completed within two (2) years of the date of project <br /> approval . (Development Title Section 9-215. 14) <br /> C. AIR QUALITY: The following regulations apply: (1) All <br /> private roads involved in the excavation shall be <br /> maintained so as to control the creation of dust. <br /> (Development Title Section 9-1410 . 3[a] ) (2) All <br /> emissions shall be subject to the rules and regulations <br /> of the San Joaquin County Air Pollution Control <br /> District. (Development Title Section 9-1410 . 3 [f] ) <br /> d. IIRIGATION DISTRICT: Provide certification of approval <br /> of proposed final grades from the South San Joaquin <br /> County Irrigation District prior to authorization being <br /> given to commence the grading excavation (Development <br /> Title Section 9-1410. 3 [b] [2] ) <br /> e. HOURS OF OPERATION: Excavation operations shall not be <br /> carried on during the hours from five (5) p.m. through <br /> six (6) a.m. , except during periods of declared <br /> national, state or local emergency. Excavation <br /> operations shall not be permitted on Saturdays and <br /> Sundays, except as otherwise noted above (Development <br /> Title Section 9-1410. 3 [d] ) <br />
