SA-98-38 OF <br /> WILLIAM & ROELYN POOT <br /> The applicants are proposing to establish a "non-conforming status" for Nursery Sales <br /> and Services-Wholesale and Retail business. The subject parcel is 1.02 acres in size <br /> and is located on the north side of State Route 120, 2,400 feet east of Murphy Road, <br /> north of Ripon. <br /> The business has been operating as a wholesale/retail nursery since 1986 without <br /> obtaining the necessary permits. The retail portion of the current business is not <br /> permitted (Use Type: Nursery Sales and Services-Retail) in the AG-40 zone. Wholesale <br /> nursery sales is a permitted use with an approved Improvement Plan application in the <br /> AG-40 zone. The Community Development Department has concluded that the project <br /> does meet the requirements for obtaining status as a "non-conforming use." Pursuant to <br /> Development Title Section 9-235.7, to obtain "non-conforming" status, the following <br /> conditions must be satisfied: <br /> Ordinance Requirements: The use shall comply with all applicable Ordinance <br /> Requirements that would have been required at the time the use was <br /> established, and: <br /> Permits: The following permits shall be required: <br /> A Site Approval or other discretionary application shall be required for the use. <br /> Other permits that normally would have been required at the time the use was <br /> established shall be obtained. <br />
