t. SWAINSON'S HAWK AND BURROWING OWL MITIGATION: The following mitigation measures shall be required: (1) Pre-construction survey for nesting Swainson's hawks within 0.25 miles of the project site boundaries shall be conducted prior to construction if construction is scheduled to occur between March 1 through September 15. In the event that nesting Swainson's hawks are located, take avoidance measures shall be undertaken as described in CDFG's Staff Report regarding Mitigation for impacts to Swainson's Hawks (CDFG, 1995). (2) Pre-construction surveys for burrowing owls within 250 feet of the project boundaries shall be conducted prior to construction if construction is scheduled to occur between February 1 and August 31. In the event that active burrowing owl burrows are located, take avoidance measures shall be undertaken as described in CDFG's Staff Report on Burrowing Ow! Mitigation (DCFG, 1994). (3) The attached Mitigation Monitoring Program for Quarry Excavation No. QX-00-01 is included as a Condition of Approval by this reference. 2. DEPARTMENT OF PUBLIC WORKS (Staff Contact: Gabe Karam, 468-3000) a. The excavation plan shall be prepared by a Registered Civil Engineer or Land Surveyor to include the following: (1) The first 100 feet from Madruga Road shall be paved. (2) A plan for the haul route using County roads shall be submitted to Public Works prior to the release of building permits. (3) No excavation or stockpiling of material shall be allowed within 25 feet of the property boundary or the County right-of-way. b. All private roads within the quarry shall be maintained to control dust. c. A video tape of the planned haul route showing conditions of all County roads shall be made. The condition of County maintained roads along the haul route shall be reviewed with Public Works prior to the start of excavation. (Development Title 9-1415.2) d. Loads on all public roads shall be restricted to legal loads only. (Street and Highway Title Section 10-2350) e. An encroachment permit shall be required for work within the Madruga Road right-of-way. (Development Title Section 9-1145.4) f. A cash deposit or security, adjusted every five years, in an amount and form acceptable to Public Works, shall be made to Public Works. The deposit shall guarantee that if the permittee fails, refuses, or neglects to repair roads along the haul route that may result from the permittee's tooperation,al or better than original condition, using the funds from said cash deposit orlic Works may do any work necessary to restore County roads gsecuthe rity I route to eq (Development Title Section 9-854.3) g. A Maintenance Agreement to ensure that County roads along haul routes are maintained to a condition acceptable to the County shall be executed by the applicant.
