A cash deposit or security, adjusted every five (5) years, in the amount and form acceptable to <br /> the Department of Public Works shall be filed with the Department with a guarantee that if the <br /> Permittee fails, refuses or neglects to repair, under permit, any damages to any County roads <br /> along the haul route which may result from permittee's operation, the Department of Public Works <br /> may do the work necessary to restore County roads along the haul route to equal or better than, <br /> original condition, using the funds from said cash deposit or security. (Development title 9-854.3) <br /> 7. A Maintenance Agreement to ensure that County roads along haul routes are maintained to <br /> a condition acceptable to San Joaquin County shall be executed by the applicant. The <br /> Maintenance Agreement shall be renewed every five (5) years. <br /> 8. A Traffic Impact Mitigation Fee will be required for this development. The Fee is due and payable <br /> at the time of excavation plan approval. The Fee currently is $164.32 per trip-end in the Manteca <br /> area. The Fee will automatically be adjusted July 1 of each year by the Engineering Construction <br /> Cost Index as published by the Engineering News Record. The number of trip-ends may be <br /> determined by a proportion to the length in time of the excavation operation. <br /> (Resolutions R-90-304, R-9-1025, R-93-167, R-94-179, R-94-650, and R-96-592) <br /> 9. A traffic study shall be prepared, prior to public hearing, to determine the impacts and mitigation <br /> measures of the following intersections: <br /> • Madruga Road and Guthmiller Road <br /> • Guthmiller Road and State Highway Route 120 <br /> • Guthmiller Road and Yosemite Avenue <br /> • Project access and Madruga Road <br /> The developer shall deposit funds with the County for all costs, as estimated by the Department <br /> of Public Works Public Facilities Division, prior to Department of Public Works preparing or <br /> contracting for the required study. Any mitigations required by the traffic study shall be <br /> provided by the applicant. (Development Title Section 9-1150.4) <br /> USE PERMIT (when required) <br /> 1. The Traffic Impact Mitigation Fee will be required for this development. The fee is due and <br /> payable at the time of building permit application. (The fee currently is $164.32 per additional <br /> daily trip-end generated in the Manteca area. The fee shall be automatically adjusted July 1 of <br /> each year by the Engineering Construction Cost Index as published by the Engineering News <br /> Record. A credit may be allowed for QX-00-01 if the existing operation on this site is retired. <br /> (Resolutions R-90-304, R-91-1025, R-93-167, R-94-179, R-95-650 and R-96-592) <br /> 2. A copy of the Final Site Plan shall be submitted prior to release of building permit. <br /> 3. Verification shall be obtained from the Solid Waste Division (468-3066) that this development <br /> has addressed the items on the attached Waste Plan Format for Development Projects.
