j. Prior to the issuance of a building permit on parcels 1, 2, or 3, the private access roadway from <br /> Cherry Street shall be constructed in conformance with fire road standards including a driveway in <br /> conformance with County Improvement Standard R-14.An encroachment permit shall be required <br /> for all work within road right-of-way. (Note: Driveway encroachment permits are for flatwork only— <br /> all vertical features, including but not limited to fences, walls, private light standards, rocks, <br /> landscaping and cobbles are not allowed in the right-of-way.)The required improvements shall be <br /> noticed on a Declaration of Major Subdivision Restriction—Non Rescindable and recorded <br /> concurrently with the Final Map (contact Department of Public Works, Development Services <br /> Division for processing) (Development Title 9-1150.15[c][d]) (A fee for processing the Declaration <br /> will be required.) <br /> I. A terminal drainage system shall be provided in accordance with the County requirements to <br /> provide adequate drainage for the subdivision. All storm drainage facilities upstream of the <br /> connection in Cherry Street shall be privately maintained. (Development Title Section 9-1135.2) <br /> m. Prior to approval of the Final Map, the developer shall prepare and record a mechanism that <br /> notices future owners and provides for maintenance of the private roadways and storm drain <br /> system. <br /> n. The project shall be served by a public water system conforming to the requirements of the San <br /> Joaquin County Public Health Services Environmental Services Division and the Department of <br /> Public Works. The system shall provide adequate domestic and fire water supply in conformance <br /> to the requirements of the County Fire Warden and the local Fire District. (Development Title <br /> Section 9-1120.2) <br /> o. The project shall be served by a public sewer collection and treatment system constructed in <br /> conformance with the requirements of the San Joaquin County Public Health Services, <br /> Environmental Services Division, and the Department of Public Works. (Development Title <br /> Section 9-1105.2) <br /> p. It is the responsibility of the applicant to ensure that a current will serve letter for sewer and water <br /> service is on file prior to the approval of the Final Map by the County surveyor. Additionally, the <br /> applicant or subsequent owner of the property, will be responsible to ensure that there is capacity <br /> in the system at the time of issuance of a building permit. <br /> q. The subdivider shall agree to and shall pay user fees for the utility services until the lots are placed <br /> on the County tax rolls. <br /> r. Access rights shall be dedicated and restricted for lots 4 and 5 along the frontage of the alley on <br /> the Final Map. The applicant shall provide written confirmation from the water providers that improvements have <br /> been constructed or financial arrangements have been made for any improvements required by <br /> the agency and that the agency has or will have the capacity to serve the proposed development. <br /> Said written confirmation shall be submitted prior to the issuance of a building permit <br /> (Development Title, Section 9-1120.2) <br /> b. Written Confirmation is required from the Public Works Department that improvements have been <br /> constructed or financial arrangements have been made for any improvements for public sewer <br /> required by the agency.
