CONDITIONS OF APPROVAL <br /> PA-0800357 <br /> M & L Commodities <br /> Use Permit Application No. PA-0800357 was approved by the San Joaquin County Planning <br /> Commission on February 5, 2009. The effective date of approval is February 15, 2009. This approval <br /> will expire on August 17, 2010, which is 18 months from the effective date of approval, unless (1) all <br /> Conditions of Approval have been complied with, (2) all necessary building permits have been <br /> secured and remain in force, and (3) all necessary permits from other agencies have been secured <br /> and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Patrick Crosby, [209]468-8597) <br /> a. BUILDING PERMIT: Submit an "APPLICATION-COMMERCIAL BUILDING PERMIT'. The Site <br /> Plan required as a part of the building permit must be prepared by a registered civil engineer or <br /> licensed architect. This Plan must show drainage, driveway access details including gates, on-site <br /> parking, landscaping, signs, existing and proposed utility services, and grading (refer to the "SITE <br /> PLAN CHECK LIST' for details). Foundation and soils investigation shall be conducted in <br /> conformance with Chapter 18 of the California Building Code at the time of permit application. A fee <br /> is required for the Site Plan review. (Development Title Section 9-884) <br /> b. APPROVED USE: This approval is for the construction of three buildings, totaling 285,644 square <br /> feet, for the Wholesaling and Distribution — Light use and to add the General Industrial— Limited and <br /> General Industrial — Intermediate uses to eight existing buildings, totaling 149,423 square feet, in a <br /> four phased project to be constructed within 10.5 years of approval. The existing Agricultural <br /> Warehousing, Wholesaling and Distribution — Light, and Truck Sales and Services — Parking uses <br /> are still permitted for the existing buildings. This approval supersedes the conditions of approval for <br /> PA-0400523. (Use types: Wholesaling and Distribution — Light; Agricultural Warehousing; Truck <br /> Sales and Services- Parking; General Industrial— Limited; and General Industrial - Intermediate). <br /> (1) Phase One would be adding the General Industrial - Limited and General Industrial— <br /> Intermediate uses to the Wholesaling and Distribution—Light; Agricultural Warehousing; and <br /> Truck Sales and Services- Parking uses in the existing buildings. <br /> A. Building A is an existing 44,000 square foot building. <br /> B. Building B is an existing 7,348 square foot building. <br /> C. Building C is an existing 5,000 square foot building. <br /> D. Building D is an existing 4,100 square foot building. <br /> E. Building E is an exiting 13,500 square foot building. <br /> F.
