Analysis <br /> Background <br /> In 1995, the Community Development Department approved Minor Subdivision No. MS-95-13, submitted <br /> by Edith A. Uhrich, which divided a 100-acre parcel into four 10-acre parcels and a remainder parcel of 60 <br /> acres. The 10-acre parcels that are proposed for division into 5-acre parcels were created by MS-95-13. <br /> According to the Subdivision Map Act, when a property owner seeks to divide property that is contiguous <br /> to land previously divided by the same owner, the earlier divisions will be counted for the purpose of <br /> determining the number of parcels created. Therefore, this subdivision is considered a Major Subdivision <br /> rather than a Minor Subdivision, even though four lots are being created now. <br /> General Plan and Zoning <br /> The General Plan designation for this property is Limited Agriculture (A/L), and the Zone classification is <br /> Limited Agriculture (AL-5)with a 5-acre minimum for new parcels. The proposed Tentative Map is <br /> consistent with the General Plan and the Development Title. <br /> Access <br /> Access to the proposed parcels will be obtained through a 50-foot-wide private road from Peltier Road. <br /> Neighborhood Opposition <br /> The Community Development Departmert has received one telephone call in opposition to the proposed Major <br /> Subdivision application. The opponent was concerned that increased development would cause storm water to <br /> drain to neighboring property.
