Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration;and
2. Approve Major Subdivision No.SU-01-1 with the Findings and Conditions of Approval contained
in the staff report.
Findings
1. The proposed subdivision is consistent with the General Plan, any applicable Master Plan, Specific
Plan, and Special Purpose Plan, and any other applicable plan adopted by the County.
This finding can be made because the proposed subdivision is consistent with the
Agricultural Lands Objectives and Principles of the General Plan. No Master Plans, Specific
Plans,or Special Purpose Plans apply.
2. The design or improvement of the subdivision is consistent with the General Plan and any Specific Plan
or Special Purpose Plan.
• This finding can be made because the number and size of the lots proposed are permitted
under the Limited Agricultural General Plan and zoning designation. No Master Plans,
Specific Plans, or Special Purpose Plans apply. The proposed parcels will have access to
Peltier Road by a 50-foot-wide private road.
3. The site is physically suitable for the type of development proposed.
This finding can be made because all development requirements contained in the
Development Title and all minimum County standards are met. The site is relatively level.
4. The site is physically suitable for the proposed density development.
This finding can be made because each parcel within the proposed subdivision will meet the
area and width requirements of the AL-5 zone.
5. Neither the design of the subdivision nor any proposed improvements are likely to cause substantial
environmental damage or substantially and avoidably injure fish or wildlife or their habitat.
This finding can be made because an Initial Study prepared for this project found no
significant, adverse impacts on the environment or upon threatened or endangered species.
6. The design of the subdivision or type of improvements is not likely to cause significant public health
problems.
This finding can be made because the Initial Study prepared for this application did not
identify any potentially significant health and safety impacts.
SU-01-1\Uhrich
San Joaquin County Page 4
Community Development
