UP-01-4 OF STUDLEY COMPANY (C/O FOODPRO INTERNATIONAL). The project is the expansion of an existing olive processing facility by the construction of an approximately 8-acre retention pond for the storage of olive process wastewater. The site is located at the end of Via Nicolo Road, 3,000 feet west of Hansen Road, southwest of Tracy. The Initial Study prepared for this project indicates that this project could have a potentially significant impact on the San Joaquin Kit Fox and the Burrowing Owl unless specified mitigation measures are adopted as conditions of approval of the project. Those mitigation measures are included in the Conditions of Approval recommended below. Those mitigation measures may be modified when comments are received from the Department of Fish and Game or the U.S. Fish and Wildlife service. The proposed negative declaration was submitted to the Sate Clearinghouse for circulation. The SCH review ends on or around March 19, 2001. This item is tentatively scheduled for the Planning Commission meeting of April 5, 2001. The Community Development Department intends to recommend approval with the following conditions: Use Permit Application No. was approved by the Planning Commission on . The effective date of approval is . This approval will expire on , which is 18 months from the effective date of approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits have been issued and remain in force, and (3) all necessary permits from other agencies have been issued and remain in force. Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled prior to the establishmentof the use and the issuance of any building permits. Those Conditions followed by a Section Number have been identified as ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and other ordinance requirements may apply.
