MS-94-50 OF THE <br /> ARNAUDO BROTHERS (C/O SIEGFRIED AND ASSOCIATES) <br /> The proposal is to create a 20 acre parcel and a 257 acre remainder <br /> parcel for the purpose of financing. The site is located southwest <br /> of Patterson Pass Road and Byron Road, northwest of Tracy, and <br /> within the new community of Mountain House. <br /> All of Parcel 1 (20 acres) is designated for Public land uses in <br /> the County General Plan as well as in the Mountain House Master <br /> Plan. In fact, a Fire Station site is included within this parcel <br /> that may need to be developed within the first three years of <br /> community development. Community Development Staff is concerned <br /> about approving the proposed minor subdivision prior the Public <br /> Land Equity Program (PLEP) being adopted since this will detail the <br /> mechanisms for CSD ownership of public properties. Although these <br /> "Preliminary" maps are permitted by the Master Plan for financing <br /> purposes prior to the PLEP and other programs being adopted, at <br /> this time it is unclear how Parcel 1 will be made available for <br /> Public purposes when needed. <br /> Unless otherwise specified, all Conditions of Approval and <br /> ordinance requirements shall be complied with prior to recording <br /> the Parcel Map. <br /> This approval will expire three (3) years from the date of approval <br /> unless, (1) all Conditions of Approval have been complied with, and <br /> (2) a Parcel Map has been filed with and accepted by the Surveyor' s <br /> Division. <br /> Those conditions followed by a Section Number or other Statutory <br /> Requirement are based on ordinance requirements. Ordinance <br /> requirements cannot be modified. <br />
