5) Fire permits may be required prior to occupancy to conduct operations hazardous to life or <br /> property. C.F.C. 105.1.1 <br /> 2. DEPARTMENT OF PUBLIC WORKS (Staff Contact: Alex Chetley, 209-468-3000) <br /> a. An encroachment permit shall be required for all work within road right-of-way. (Note: Driveway <br /> encroachment permits are for flatwork only—all vertical features, including but not limited to <br /> fences, walls, private light standards, rocks, landscaping and cobbles are not allowed in the right- <br /> of-way.) (Development Title Sections 9-1145.4 and 9-1145.5) <br /> b. The driveway approaches shall be improved in accordance with the requirements of San Joaquin <br /> County Improvement Standards Drawing No. R-17 including return radii to accommodate truck <br /> turning movements prior to issuance of the occupancy permit for the first phase of the project. <br /> (Development Title Section 9-1145.5) <br /> c. All vehicular parking related to applicant's proposed development shall be onsite at all times. <br /> Parking in the County right-of-way for all winery-related events shall be prohibited. It is the <br /> responsibility of applicant to monitor Peltier Road to ensure compliance with this requirement. <br /> d. If any marketing events are held for more than 150 people, the Department of Public Works <br /> reserves the right to require a traffic study to determine the impacts and mitigation of the <br /> proposed project. The applicant shall deposit funds with the County for all costs, as estimated by <br /> the Department of Public Works Transportation Engineering Division prior to the Department <br /> preparing or contracting for the required study. (Development Title Section 9-1150.4) <br /> e. The property owner shall execute an Irrevocable Offer and Agreement to Dedicate Road to result <br /> in a forty-two-foot(42')wide right-of-way from the centerline of Peltier Road to the property line <br /> across the parcel's frontage prior to issuance of building permit for the first phase of the project. <br /> (A fee based on the current fee schedule at time of payment is required for processing per <br /> Development Title Table 9-240.2 in addition to a copy of the Grant Deed and a legal description <br /> of the parcel to be offered for dedication.) (Development Title Section 9-1150.5) <br /> f. The Traffic Impact Mitigation Fee shall be required for this development for each phase of the <br /> project. The fee is due and payable at the time of building permit application for each phase. <br /> The fee shall be automatically adjusted July 1 of each year by the Engineering Construction Cost <br /> Index as published by the Engineering News Record. (Resolution R-00-433) <br /> g. The Regional Transportation Impact Fee shall be required for this development for each phase of <br /> the project. The fee is due and payable at the time of building permit application for each phase. <br /> The fee will be based on the current schedule at the time of payment. (Resolution R-06-38) <br /> h. A copy of the Final Site Plan shall be submitted prior to release of building permit for each phase <br /> of the project. <br /> i. For each phase of the project, verification shall be obtained from the Solid Waste Division (468- <br /> 3066)that this development has met the requirements of the Waste Plan Format for Development <br /> Projects. Final Site Plan is required upon submittal of verification. <br /> j. For each phase of the project, the developer shall provide drainage facilities and meet the <br /> requirements of San Joaquin County Development Standards to prevent the increased runoff <br /> release rate of storm water from discharging onto other properties and to prevent offsite sediment <br /> transport. Retention basins shall be fenced with six(6) foot high chain link fence or equal when <br /> the maximum design depth is 18 inches or more.
