However, this project is being referred to the Planning Commission due to four letters <br /> of opposition that were received (attached). The only issue raised in the letters was the incompatibility <br /> of residences in an agricultural area <br /> POLICY CONSIDERATIONS: <br /> General Plan and Zoning: <br /> This application is being processed pursuant to the 1995 General Plan and Planning Title. This <br /> site is designated Agriculture on the General Plan and is zoned AG-40. <br /> The Planning Title provides area exceptions for the creation of a homesite parcel for an owner- <br /> operator. <br /> SECTION 9-4010.2(a). <br /> Homesite Parcel For Owner-Operator. A homesite parcel containing a minimum <br /> of one and one-half (11/2) acres may be created from a parcel twenty (20) acres <br /> or larger in size to finance or refinance a residence for the owner-operator... <br /> There is no evidence in the file to suggest than the owner does not qualify under the above <br /> section. <br /> Williamson Act: <br /> Because the property is under Williamson Act contract, the homesite parcel being created must <br /> be 10 acres in size. <br /> ENVIRONMENTAL CONSIDERATIONS: <br /> An Initial Study was prepared for this project on September 1, 1992, and no significant environmental <br /> impacts were identified. On the basis of that review, a Negative Declaration was prepared. In addition, <br /> a Certificate of Fee Exemption with a'De Minimis Impact Finding' has been prepared which indicates that <br /> this project could not have a significant impact on fish and wildlife resources. <br />
