CONDITIONS OF APPROVAL <br /> MS-94-12 <br /> Rick & Julie Miller <br /> Unless otherwise specified, all Conditions of Approval and Ordinance Requirements shall be <br /> complied with prior to the approval of the Parcel Map. <br /> This approval will expire three (3) years from the date of approval unless (1) all Conditions of <br /> Approval have been complied with and (2) a Parcel Map has been filed with and accepted by the <br /> Surveyor's Division. <br /> Those Conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance requirements. Ordinance Requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. Parcels 1 and 2 shall contain at least five acres gross (Development Title Section 9-610.2). <br /> Parcel sizes shall be shown on the Parcel Map. <br /> b. The minimum width of Parcels 1 and 2 shall be 200 feet (Development Title Section 9- <br /> 610.4). Parcel widths shall be shown on the Parcel Map. <br /> C. Provisions for storm water drainage on Parcels 1 and 2 shall be consistent with Section <br /> 9-1135.9 of the Development Title. <br /> 2. DEPARTMENT OF PUBLIC WORKS: <br /> a. A Parcel Map is required. (Development Title Section 9-915.2) <br /> b. An Offer of Dedication shall be required along the south 25 feet of Parcel 2. <br /> (Development Title Section 9-860.4) <br /> C. The Traffic Impact Mitigation Fee will be required when the parcels are developed. The <br /> fee is due and payable at the time of building permit application. The fee currently is <br /> $1,900.00 per single-family in the Lodi area. The fee shall be automatically adjusted July <br /> 1 of each year by the Engineering Construction Cost Index as published by the <br /> Engineering News Record. (Resolutions R-90-304, R-91-1025) <br /> d. The frontage improvements for Parcel 1 along Peltier Road shall be constructed in <br /> conformance with the standards for one-haff of an 84-foot-wide right-of-way rural arterial <br /> road. The frontage improvements for Parcel 2 along Lubell Lane (private road) shall be <br /> constructed in conformance with the standards for one-haft of a 50-foot-wide right-of-way <br /> rural residential road. The construction of the frontage improvements will be deferred, <br /> upon execution by the owner of a Deferred Frontage and Roadway Improvement <br /> Agreement or a Secured Deferred Frontage and Roadway Improvement Agreement with <br /> a deposit equivalent to the estimated construction costs prior to approval of the Parcel <br /> Map. A $260.00 fee currently is required for processing, per Development Title Table 9- <br /> 240.2, in addition to a copy of the Grant Deed, recording fee, legal descriptions of Parcels <br /> 1 and 2, and an estimate of construction costs for each parcel, respectively. The estimate <br /> and legal descriptions shall be prepared by a Registered Civil Engineer with a typical <br /> Conditions of Approval - 1 - MS-9412 <br />
