"Seat", as used in this Agreement, shall be defined as that <br /> portion of the school capacity related to one child. New elementary <br /> schools will have a traditional calendar capacity of 650 (seats), <br /> middle schools 800 (seats), and high schools 1,800 ( seats). <br /> "Generation Factor" as used in this Agreement, shall be <br /> defined as the computed number of students per housing unit as <br /> used in the District's Capital Improvement Plan 2000. <br /> "Pro rata share" as used in this Agreement, shall be <br /> defined as the cost of an elementary, middle and/or high school seat <br /> divided by the school capacity (650 for elementary, 800 for middle <br /> and 1800 for high schools), times the number of students to be <br /> generated by the development, using the District's Generation Factor <br /> as defined, or alternative generation factors as mutually agreed upon <br /> by the District and the Developer. <br /> 2. Provision of School Facilities <br /> Developer shall provide for elementary, middle and high <br /> school facilities based on the anticipated number of students <br /> generated by the development, in one or more ways as defined <br /> below: <br /> A. Developer shall approve the formation of, or annexation <br /> to, a community facilities district, including: approving the <br /> authorization to levy a special tax; approving the authorization to <br /> incur bonded indebtedness secured by a special tax to finance the <br /> pro rata share of school facilities and financing costs; and approving <br /> the authorization to issue and sell bonds in an aggregate principal <br /> amount sufficient for purposes of financing the pro rata share of <br />
