proportion to the specific number of students anticipated to be <br /> generated by Developer development. <br /> WHEREAS, District subventions from the State are adequate <br /> only to cover operational expenses, and State funds for school <br /> construction are extremely limited, to nonexistent; therefore, causing <br /> the funding of adequate school facilities to become the responsibility <br /> of the local community that requires those facilities. <br /> WHEREAS, the Developer desires to have the project move <br /> forward without opposition from the District, and the District desires <br /> to secure a binding and enforceable agreement from the Developer <br /> which will guarantee implementation of a mechanism for the funding <br /> of school facilities necessary to serve the residents of the <br /> Development. <br /> WHEREAS, the Developer, in order to proceed with the <br /> development, may be required to obtain approval of a subdivision <br /> map and/or other approvals and other actions which may be subject <br /> to opposition from District. <br /> WHEREAS, the District is encouraging and facilitating the <br /> creation of area wide school financing mechanism for use by new <br /> development to meet adequate school provisions for the North <br /> Stockton area. This North Stockton area financing will be a plan <br /> which may include Mello Roos community facilities districts or other <br /> electorate mechanisms. <br /> NOW, THEREFORE, in consideration ,of the terms and conditions <br /> herein set forth, District and Developer hereby agree as follows: <br /> 1 .
