participate in the development and approval process of the Finance <br /> Plan(s). <br /> 6. Non-opposition <br /> In consideration of Developer's commitment to provide <br /> adequate school facilities to serve development, District shall not <br /> oppose Developer's development and shall inform the appropriate <br /> bodies of the local agency that the development will make provisions <br /> for its pro rata share of adequate school facilities prior to approval <br /> of the subdivision. If Developer or assign or successor, has not <br /> signed the 'final agreement(s)' for provision of school facilities, <br /> pursuant to Paragraph 2, before approval of the subdivision by the <br /> Stockton City Planning Commission, the District will oppose the <br /> proposed development on the grounds of inadequate school facilities, <br /> and continually pursue denial of the project. <br /> 7. Developer Fees <br /> Developer may, at his/her/its option, request that District <br /> waive developer fees, as defined in Government Code Section 65970 <br /> et seq. pursuant to "in-lieu" provisions in the Education and/or <br /> Government Codes, or may, at his/her/its option, pay school <br /> developer fees levied pursuant to Section 65970 et seq. and apply <br /> said payment toward the total requirements of Paragraph 2 above. <br /> 8. Third Party Beneficiaries <br /> District and Developer agree that this Agreement is by and <br /> between the parties named herein, and or their successors and <br /> assigns and no third party is intended, expressly or by implication, to <br /> be benefited by this Agreement. <br />
