participate in the development and approval process of the Finance Plan(s). 6. Non-opposition In consideration of Developer's commitment to provide adequate school facilities to serve development, District shall not oppose Developer's development and shall inform the appropriate bodies of the local agency that the development will make provisions for its pro rata share of adequate school facilities prior to approval of the subdivision. If Developer or assign or successor, has not signed the 'final agreement(s)' for provision of school facilities, pursuant to Paragraph 2, before approval of the subdivision by the Stockton City Planning Commission, the District will oppose the proposed development on the grounds of inadequate school facilities, and continually pursue denial of the project. 7. Developer Fees Developer may, at his/her/its option, request that District waive developer fees, as defined in Government Code Section 65970 et seq. pursuant to "in-lieu" provisions in the Education and/or Government Codes, or may, at his/her/its option, pay school developer fees levied pursuant to Section 65970 et seq. and apply said payment toward the total requirements of Paragraph 2 above. 8. Third Party Beneficiaries District and Developer agree that this Agreement is by and between the parties named herein, and or their successors and assigns and no third party is intended, expressly or by implication, to be benefited by this Agreement.
