October 4, 2004
San Joaquin County Reo'elve®
Community Development Department
Development Services Division
1810 E.Hazelton Ave. OCT 0 6 2004
Stockton, CA 95205 Co Bu Id ng DeIrIsvelop, hent L) PL
ATTN: Kevin Swanson pectiOn Div
RE: Application Number PA-0400498(UP)
Roxanne Kalend &Howard Seligman
P. O. Box 455 Seligman& Willet, Inc.
Victor,CA 95253 7540 Shoreline Drive, Suite G
Stockton, CA 95219
Dear Mr. Swanson:
Please accept this as a letter in opposition to the above noted application referral notice
recently received from your department. The concerns supporting the opposition are as
follows:
1) Eight Mile Road, although heavily traveled, is not adequate for heavy truck
traffic. The roadway is a standard rural roadway of only 24 feet wide. The
area is not conducive to truck traffic and approval of this application would
encourage heavy truck traffic in the area. This will cause damage in the form
of wear and tear to the roadway.
2) There is a concern of future expansion by the applicants. The project
description notes two phases of construction currently. There is a likelihood
that there could be additional phases in the future.
3) Repair and servicing of the trucks on the property will cause oil to penetrate
into the ground and contaminate the underground aquifer. All residences in
the area are on separate wells and water contamination is of great concern.
4) A potential fire hazard already exists due to the current lack of maintenance of
surrounding property. Dry grass and weeds cover the adjoining areas and
allowing trucks only increases the fire hazard that already exists.
5) Truck traffic will cause dust and other debris to be circulated in the air, aside
from the pollution from diesel engines.
6) Noise is another concern in that trucks generally run both day and night.
Additionally, if the trailers are refrigeration units, noise will be constantly
present from the refrigerators running.
