h. SETBACKS: The structure shall comply with the following setback requirements: <br /> (1) The proposed tower and accompanying equipment shelter shall be set back a minimum of thirty <br /> feet fromlhe front and street side yard property lines, (Development Title Section 9-610.5) <br /> (2) The proposed tower and accompanying equipment shelter shall be set back a minimum of ten <br /> feet from the side yard property line. (Development Title Section 9-610.5) <br /> (3) New freestanding support structures shall be located a distance equal to at least the height of <br /> the said structure from residential structures on adjoining properties. <br /> I. MAINTENANCE OF FACILITIES: All freestanding structures, antennas, and supporting equipment <br /> associated with the radio tower shall be maintained in good condition by the provider of the facility <br /> and, whenever necessary, repaired or replaced. <br /> I. REMOVAL OF FACILITIES: Freestanding structures, antennas, and supporting equipment <br /> associated with the radio tower shall be removed by the provider of such facilities and the site <br /> restored to its pre-construction state if said facilities have not been operational or used for a period of <br /> six (6) consecutive months. Removal and site restoration shall be completed within ninety (90) days <br /> of the end of said six (6) month period. <br /> k TOWER LIGHTS: For safety purposes, the radio tower shall be lighted according to the following <br /> (1) A red light shall be placed at or near the top of the tower. <br /> (2) A red light shall be placed at the vertical mid-point of the tower <br /> (3) The lights shall operate twenty-four hours a day. <br /> (4) The lights shall conform to all lighting standards required by the Federal Aviation Administration. <br /> 2 DEPARTMENT OF PUBLIC WORKS (Staff Contact: Michael Callahan, 468-3000) <br /> a. An encroachment permit shall be required for work within the road right-of-way. (Development Title <br /> Sections 9-1145 4 and 9-1145.5) <br /> b. The driveway approach shall be improved in accordance with the requirements of San Joaquin <br /> County Standard R-17 prior to issuance of the occupancy permit. (Development Title Section 9- <br /> 1145.5) <br /> c. Dedication to result in a 25-foot-wide right-of-way from the centerline of Cora Post Road to the <br /> property line shall be required across the frontage of APN 059-260-01. Dedication;shall be made on <br /> a separate instrument (Development Title Section 9-1150.5) <br /> d. The frontage improvements for N. State Route 99 E. Frontage Road shall be constructed in <br /> conformance with the standards for one-half of a 50-foot-wide right-of-way rural street, prior to <br /> finalization of the Site Approval. (Development Title Section 9-1150.2) <br /> e. The Traffic Impact Mitigation Fee shall be required for this development. The fee is due and payable <br /> at the time of building permit application. The fee currently is $2,069.00 per 1,000 gross square feet <br /> of building designated as Office in the Stockton area.
