The parcel has a General Plan Designation of C/FS <br /> (Commercial Freeway Service) and the property is zoned C-FS (Commercial Freeway <br /> Service). <br /> The .88 acre site is located on the east side of W. State Route 99 West Frontage Road, <br /> 650 feet north of E. Lathrop Road, Manteca. <br /> Background <br /> On April 18, 2005 the Community Development Department approved Site Approval <br /> application No.PA-0500092 for one 45 foot off- premises double faced v-shaped <br /> illuminated billboard sign. The construction of the sign was completed on April 27,2005, <br /> once the construction of the sign was completed the applicant realized that the sign was <br /> not visible to the northbound traveler on State Route 99. <br /> Policy Considerations <br /> For a Variance application to be approved, three findings for a Variance must be made <br /> in the affirmative. The applicant submitted findings for approval of the application. <br /> Findings No.1 and 2 cannot be made in the affirmative. <br /> Finding No. 1: Special Circumstances <br /> Because special circumstances applicable to the property, including size, shape, <br /> topography, location, or surroundings, the strict application of the regulation <br /> deprives the property of privileges enjoyed by other property in the vicinity and <br /> under identical zoning classification. <br /> I <br />
