Applicant's Statement. "The clear view of the south face of the off-premises sign is <br /> blocked by the Lathrop Road Overpass. Other signs in the Manteca area have been <br /> permitted to 60 feet so this would be consistent with that signage. Also many Variances <br /> have been granted along 1-5 near Manteca corridor for same reasons." <br /> • This finding cannot be made because the property does not have any special <br /> circumstances applicable to it that deprives it of privileges enjoyed by other <br /> properties in the vicinity and under identical zoning classification. The parcel is <br /> flat land of sufficient size and shape that is similar to surrounding properties. The <br /> parcel is located 700 feet north of the Lathrop Road overpass, and the <br /> surrounding parcels do not contain any signs of similar nature. Other C-FS zoned <br /> parcels in the vicinity are similarly impacted by the freeway overpass. <br /> Finding Two: No Special Privileges <br /> The granting of the Variance will not constitute a grant of special privileges <br /> inconsistent with the limitations upon other properties in the vicinity and zone in <br /> which the property is situated. <br /> Applicant's Statement: "By granting this additional height of 13 feet it will not adversely <br /> affect any other property for a negative fashion. It will have more separation of north face <br /> and Valero Gas Signage so as not to confuse motoring public". <br /> • This finding cannot be made because granting this Variance will constitute a <br /> grant of special privileges. The surrounding properties are similar in nature and <br /> zoning and are subject to the height limitations for off-premises signs in the C-FS <br /> (Commercial Freeway Service) zone. Other C-FS zoned parcels in the vicinity <br /> are similarly impacted by the freeway overpass. Therefore the granting of this <br /> Variance will grant the applicant privileges that are not enjoyed by the <br /> surrounding properties. <br /> Finding Three: Use Authorized <br /> The Variance will not authorize a use or activity which is not otherwise expressly <br /> authorized by the regulation governing the parcel of property. <br /> Applicant's Statement: "A permit has already been issued for this authorized use for a <br /> sign on this parcel. This request seeks only a slight modification of raising the current <br /> sign of 45 feet to a height of 58 feet". <br /> This finding can be made because the Variance application does not authorize a <br /> use that is not otherwise expressly authorized by the General Plan or <br /> Development Title. Off-Premises Signs maybe conditionally permitted in the C- <br /> FS (Commercial Freeway Service) zone with an approved Site Approval <br /> application. This Variance is for height only, there are no changes proposed for <br /> the use. <br /> 2 <br />
