PA-0500008 OF AGUSTIN & <br /> JUANA POLANCO (APN: 197-100-08) <br /> The applicant has submitted the above referenced Site Approval pre-application for a <br /> 1,130 square foot addition to an existing 1,155 square foot nonconforming residence. <br /> There is an existing detached garage on the property as well. The existing residence <br /> was constructed in 1948. The property is zoned C-FS (Freeway Service Commercial) <br /> and has a General Plan designation of C/FS (Freeway Service Commercial). Single <br /> family residences are not a permitted use in the C-FS zone and a Site Approval is <br /> required to expand any existing nonconforming residences. <br /> The project site is located on the east side of South State Route 99 Frontage Road, 535 <br /> feet north of East Lathrop Road, north of Manteca. <br /> The Community Development Department has reviewed the proposed Site Approval <br /> pre-application and offers the following comments: <br /> Nonconforming Structure <br /> A nonconforming structure is a building that was legal when constructed but no longer <br /> complies with the Development Title. Development Title Section 9-235.3 states that a <br /> nonconforming use may be continued as long as it remains otherwise lawful, subject to <br /> the following provisions: <br /> (1) If the nonconforming use is not conducted within a structure but on land only, <br /> such use shall not be enlarged, increased, or extended to occupy a greater area <br /> of land than was occupied on the effective date of this Chapter; <br /> • The proposed use will be conducted within a structure. <br /> I <br />
