(2) If the nonconforming use is conducted wholly or partially within a structure <br /> devoted to the nonconforming use, the structure devoted to the nonconforming <br /> use may be enlarged, extended, or remodeled, subject to Site Approval; and <br /> • The proposed residential use will be conducted within a structure <br /> (residence). <br /> (3) If the nonconforming use is superseded by a conforming use, or if the <br /> nonconforming use ceases for any reason for a period of more than twelve (12) <br /> consecutive calendar months, any subsequent use shall conform to the <br /> requirements of this Title for the zone in which it is located and the <br /> nonconforming use may not thereafter be resumed. <br /> • The proposed use has not been superseded by a conforming use. The <br /> existing residence was constructed in 1948. The current owners have <br /> resided in the residence since 2002. <br /> Setback Requirements <br /> Development Title Section 9-410.5(b)[1] states that in a commercial zone, if a side yard <br /> abuts property developed with residential uses, property zoned residentially, or property <br /> shown on the General Plan Map for residential development, said side yard shall be <br /> increased to twenty (20) feet in width. The property to the north of the proposed project <br /> is zoned R-L. As a result, the northern side yard setback shall be a minimum of 20 feet <br /> for any new construction. <br /> NOTE: The pre-application conference is designed to inform prospective applicants of <br /> General Plan consistency, zoning consistency, public improvement requirements, <br /> preliminary design constraints and opportunities, and major environmental and safety <br /> issues. This information is provided in the hope of assisting the applicant in submitting a <br /> better and more complete application, as well as minimizing processing time. It is not <br /> intended to be an in-depth analysis, and an environmental assessment is not completed. <br /> The applicant should be aware that a detailed review will not be done until the full <br /> application is submitted.
