JO L. ALVA
ATTORNEY AT LAW
7540 Shorefine Dr.,Suite G (C
n D
Stockton,CA. 95219 t\,/J
(209)477-6061 Fax:(209)951-2153
3 April 2002
Victor Mow, Chairman
Board of Supervisors
San Joaquin County
222 E. Weber Avenue
Stockton, CA 95202
Re: Request for Board Direction to the Community Development Department regarding
submital of a re-zoning application to address a condition of conditional zone
number ZR-93-6 (Copy of the zone reclassification is attached).
Honorable Chairman Mow:
On behalf of Mr. Lester Calkins, owner of property located on the north east quadrant of
State Route 99 and Woodbridge Road,I am requesting that the above referenced issue be placed on
the Board of Supervisors agenda as soon as possible.
In 1993 the Board of Supervisors adopted zone reclassification number ZR-93-6 which
applied Conditional Zoning I-US.10 to my client's property. The conditional zone incorporates two
conditions. We wish to address the Board of Supervisors regarding the elimination of one of the two
conditions at a future hearing. The Community Development Staff and County Counsel, have
determined that the procedure to address the Board on this issue, is for us to file a reclassification
application. We are willing to file the reclassification application and pay the requisite fees.
However, there is the additional requirement that a soil suitability study be included as a part of the
reclassification application, and we believe that in this instance the soil suitability study should not
be required.
I am requesting that the Board direct the Community Development Director to process the
reclassification application without a soil suitability study, since regardless of the outcome of our
request, the zone for the property will continue to'be Conditional Zoning I-L/S.10.
Please advise me as to when you may be able to place this matter on the Board's agenda. If
you or your staff have any questions, please feel free to contact me.
Sincere ,
i
JO L. VA
Attorney at Law
c:Lester Calkins
