Analysis <br /> Background <br /> On July 27, 1993, the Board of Supervisors directed the Community Development Department to process <br /> a General Plan Amendment to change the designation of five (5) parcels totaling twenty (20) acres from <br /> A/G (General Agriculture) to I/L (Limited Industrial) to recognize existing industrial uses. A Zone <br /> Reclassification application was processed concurrently with the General Plan Amendment so that the <br /> zoning would be consistent with the General Plan. <br /> On December 14, 1993, the Board of Supervisors approved General Plan Amendment No. GP-93-7 and <br /> conditionally approved Zone Reclassification No. ZR-93-6. The Zone Reclassification application <br /> changed the zoning of three parcels west of State Route 99 from M-1/L (Limited Manufacturing, L <br /> Combining zone) to I-L (Limited Industrial/S.10). Two other parcels on the east side of State Route 99 <br /> zoned AG-40 (General Agriculture, 40-acre minimum) and C-M/L (Commercial-Manufacturing, L <br /> Combining zone) were also reclassified to I-L (S.10). The conditional zoning (I-L/S.10) stated that new <br /> development projects would require public services and that any new or expanded uses would require <br /> documentation that there would be no increased demand on the water supply and remain in compliance <br /> with the intent of the County Water Policy. The Environmental Health Department was concerned that <br /> any new development projects operating without the benefit of public services would result in future public <br /> health problems. As a result, the parcels were conditioned to prevent any future public health problems <br /> from occurring. <br /> The five parcels included the following existing industrial uses: a personal storage facility with a sporting <br /> goods manufacturing, a packing and distributing company, a truck rental company, a mobile home tire <br /> sales company, and a company which recycled mobile home tires and axles. <br /> Environmental Health Department <br /> The Environmental Health Department (EHD) states that in the past there have been numerous problems <br /> with wastewater discharge violations and flooding and drainage problems in the project vicinity. The EHD <br /> is concerned that eliminating Condition 1 could potentially allow the use of on-site septic systems for <br /> sewage disposal that is not advisable for this location. Specifically, the EHD is concerned with the <br /> northeast quadrant of this I-L (S.10) zone, which consists of a mini-storage facility with sewage disposal <br /> provided by a package treatment facility at Arbor Mobile Home Park. A violation of wastewater discharge <br /> was recently issued to the mobile home park by the Central Valley Regional Water Quality Control Board. <br /> In addition, the mobile home park has endured severe flooding and drainage problems in the past 25 <br /> years that have resulted in the evacuation of people by boat and 4-wheel-drive vehicles. The elimination <br /> of zoning Condition 1. could potentially result in similar public health and environmental problems. <br /> Zone Reclassification <br /> Prior to approving a Zone Reclassification application, the Planning Commission and the Board of <br /> Supervisors must determine that the following two (2) Bases for Zone Reclassification can be made: <br /> a. The proposed zone district is consistent with the General Plan, any applicable Master Plan, <br /> and any applicable Specific Plan; and <br /> b.
