The Board of Supervisors previously determined that conditionally approving ZR-96-3 was consistent with <br /> the General Plan. They also determined that with the conditional zoning, the Zone Reclassification was <br /> reasonable and beneficial at the time. If Condition 1 is removed from the I-L/S.10 zoning, neither of the <br /> two required Bases for Zone Reclassification can be made. The first Basis for Zone Reclassification <br /> cannot be made because, although the I-L zone is a consistent implementing zone for the I/L General <br /> Plan designation, removing Condition 1 would be inconsistent with General Plan Growth Accommodation <br /> Implementation Policy 14.(a)(2), which states: <br /> 14.(a) In reviewing an application for a Zone Reclassification of land to an urban use, the <br /> following criteria shall be considered: <br /> (2) that adequate services can be made available for the development permitted in <br /> the zone. <br /> The purpose of Condition 1 was to recognize the existing development of the property and to prohibit new <br /> development until full public services are available, consistent with the above-referenced General Plan <br /> Implementation Policy. <br /> The second basis for Zone Reclassification cannot be made because the Environmental Health <br /> Department"feels strongly that providing monitored wastewater treatment (public), public water, and <br /> drainage is appropriate to protect public health and future environmental problems."
