The Board of Supervisors previously determined that conditionally approving ZR-96-3 was consistent with the General Plan. They also determined that with the conditional zoning, the Zone Reclassification was reasonable and beneficial at the time. If Condition 1 is removed from the I-L/S.10 zoning, neither of the two required Bases for Zone Reclassification can be made. The first Basis for Zone Reclassification cannot be made because, although the I-L zone is a consistent implementing zone for the I/L General Plan designation, removing Condition 1 would be inconsistent with General Plan Growth Accommodation Implementation Policy 14.(a)(2), which states: 14.(a) In reviewing an application for a Zone Reclassification of land to an urban use, the following criteria shall be considered: (2) that adequate services can be made available for the development permitted in the zone. The purpose of Condition 1 was to recognize the existing development of the property and to prohibit new development until full public services are available, consistent with the above-referenced General Plan Implementation Policy. The second basis for Zone Reclassification cannot be made because the Environmental Health Department"feels strongly that providing monitored wastewater treatment (public), public water, and drainage is appropriate to protect public health and future environmental problems."
