the project site. They include a truck repair business, a pallet storage business, and
operation of a truck terminal.
Background
On December 14, 1993, the Board of Supervisors approved General Plan Amendment
GP-93-7 and Zone Reclassification ZR-93-6 in order to recognize existing industrial
uses. The project area consisted of five (5) parcels totaling approximately twenty (20)
acres and included the following industrial uses: a personal storage facility with a
sporting goods manufacturing, packing and distributing company. a truck rental
company, a mobile home tire sales company and a company which recycled mobile
home tires and axles.
General Plan policies permitted the parcels to be formally designated as industrial on the
General Plan map because of the existing industrial uses. The General Plan policies
also stated that once an industrial area was recognized, the area could be allowed to
expand even though it was not within a community, if a General Plan Amendment is
approved.
The approval of Conditions 1 and 2 (I-L/S.10) ensured that new development projects
would require public services and that any new or expanded uses would require
documentation that there would be no increased demand on the water supply, and
remain in compliance with the intent of the County Water Policy.
Environmental Health Department
The Environmental Health Department indicated that in the past there have been
numerous problems with wastewater discharge violations and flooding and drainage
problems in the project vicinity. The Environmental Health Department is concerned that
eliminating Condition 1 has the potential of allowing the use of onsite septic systems for
sewage disposal that is not advisable for this location.
The Community Development Department has reviewed the proposed application and
will be recommending to the Planning Commission, at the meeting tentatively scheduled
for November 21, 2002, that the application be denied based on the inability to make the
second basis (b.) for Zone Reclassifications.
Zone Reclassification
Prior to approving an application for a Zone Reclassification, the Planning Commission
and the Board of Supervisors shall determine that the following two (2) bases for zone
reclassifications can be made:
a. The proposed zone district is consistent with the General Plan, any applicable
Master Plan, and any applicable Specific Plan; and
b. The proposed zone district is reasonable and beneficial at the time
(Development Title Section 9-812.4).
The Board of Supervisors previously determined that conditionally approving ZR-96-3
was consistent with the General Plan and reasonable and beneficial at the time. If
Condition 1 is removed from the I-L/S.10 zoning, the second basis for Zone
Reclassifications cannot be made because the Environmental Health Department "feels
