Main Street <br /> Stockton, CA 95202-3029 <br /> Re: Arbor Mobilehome Park—Private Water and Sewer System <br /> Dear Mr. Estrada: <br /> Our client, the current owner of Arbor Mobilehome Park, asked me to respond to your <br /> questions regarding the post-conversion ownership and maintenance of the Park's on-site private <br /> water and sewer system (the "System"). <br /> After the Park's conversion to a common interest development("CID"), the System, as <br /> well as the other common areas and facilities at the Park will be owned and maintained by a <br /> homeowners' association (the "HOA"), which will be a California non-profit corporation, <br /> formed pursuant to California Civil Code §§ 1350 through 1373 and 1468, to act as a <br /> homeowner's association of a CID under the Davis-Stirling Common Interest Development Act <br /> (the "Act"). While each lot owner in the Park will belong to the HOA, the HOA will be a single, <br /> separate and distinct legal entity, and will own the System in its own name. Therefore, the <br /> System will not be owned in common by multiple parties, but rather solely by the HOA. <br /> The HOA will have a board of directors and elected officers, and the president and other <br /> officers of the HOA will have delegated responsibilities. Furthermore, the California <br /> Department of Real Estate (the "DRE"), which oversees the establishment of new CIDs and <br /> homeowners' associations, requires that the HOA name or contract with experienced <br /> management, as well as provide evidence of all current operating permits and satisfaction of all <br /> other governmental requirements,prior to approving the HOA and the CID, It will be an officer <br /> or a hired management company who will be your designated"point person"with respect to the <br /> operation and maintenance of the System. Thus, you will not be interacting with a large, <br /> fractious group. Throughout California, homeowners' associations independently manage and <br /> operate CIDs ranging from small buildings with a few units to massive high-rises with hundreds <br />
