CONDITIONS OF APPROVAL <br /> SA-99-11 <br /> Vaz <br /> Site Approval Application No. SA-99-11 was approved by the San Joaquin County Planning <br /> Commission on April 1, 1999. The effective date of approval is April 11, 1999. This approval will <br /> expire on October 10, 2000, which is 18 months from the effective date of approval, unless (1) all <br /> Conditions of Approval have been complied with, (2) all necessary building permits have been <br /> secured and remain in force, and (3) all necessary permits from other agencies have been secured <br /> and remain in force. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Jeff Fisher,468-9653) <br /> a. BUILDING PERMIT: Submitan "APPLICATION-COMMERCIALBUILDING PERMIT." The <br /> Site Plan required as a part of the building permit must be prepared by a registered civil <br /> engineer or licensed architect. This Plan must show drainage,driveway access details <br /> (including gates),on-site parking, landscaping,signs, existing and proposed utility services, <br /> and grading(refer to the"SITE PLAN CHECKLIST"for details). A fee is required for the <br /> Site Plan review. (Development Title Section 9-884) <br /> b. APPROVED USE: This approval is for a 95-foot-high monopole cellular communications <br /> tower and a 3-foot by 5-foot equipment shelter as shown on the Plan submitted January 27, <br /> 1999. <br /> C. SIDE YARD SETBACK: The proposed tower and accompanying equipment shall be set <br /> back a minimum of ten (10) feet from the south property line. MAINTENENCE OF FACILITIES: All freestanding structures, antennas, and supporting <br /> equipment associated with wireless telecommunication shall be maintained in good <br /> condition by the provider of the telecommunication facility and, whenever necessary, <br /> repaired or replaced. (Development Title Section 9-1065.7) <br /> e. REMOVAL OF FACILITIES: Freestanding structures,antennas,and supporting equipment <br /> associated with wireless telecommunication shall be removed by the provider of such <br /> facilities and the site restored to its pre-construction state if said facilities have not been <br /> operational or used for a period of six(6)consecutive months. Removal and site restoration <br /> shall be completed within ninety(90)days of the end of said six(6) month period. To <br /> guarantee removal of unused or abandoned facilities,the Review Authority may require the <br /> applicantto post a bond or other suitable security instrument.
