Riparian Habitat <br /> An existing natural pond is located on Parcels 2 and 3. Riparian habitat consisting of cattails and willows <br /> exist around the edge of the pond. Development Title Section 9-1510.5 states that parallel to any natural <br /> bank of waterway, a natural open space for riparian habitat and waterway protection shall be maintained to <br /> provide nesting and foraging habitat and the protection of waterway quality. The minimum width of said <br /> open space shall be one-hundred (100) feet, measured from the mean high water level of the natural bank <br /> or fifty (50)feet back from the existing riparian habitat, whichever is greater. As a result, the applicant will be <br /> required to maintain a one-hundred (100) foot buffer zone around the edge of the existing pond. The <br /> restriction will be on the Final Map and recorded as a separate instrument. <br /> Furthermore, any future improvements or structures that require ground disturbance on this or subsequent <br /> divided parcels will be subject to participation in the San Joaquin Council of Governments Multi-Species <br /> Habitat Conservation and Open Space Plan (SJMSCP). <br /> Protect Opponents <br /> The Community Development Department has received a letter from a neighbor expressing concerns about <br /> flooding. The letter states that flooding caused by drainage of State Route 99 W. Frontage Road and <br /> Liberty Road has caused the property owner of the subject parcel to exit the through the concerned party's <br /> parcel. <br /> The northern part of the property is in the 100-year flood plain. As a result, the Department of Public Works <br /> required the preparation of a flood study and storm water management plan. In April of 2006, the applicant <br /> submitted the required study and plan. The studies concluded that if individual lots retained their own runoff, <br /> and if the subdivision complied with County standards, flooding would not increase and upstream and down <br /> stream levels of the creek would not be significantly affected. The Department of Public Works has <br /> reviewed the study and concurs with the study's conclusions. Furthermore, ingress and:egress access to <br /> V the subdivision will be provided by State Route 99 West Frontage Road via a 50 foot wide private road. <br /> Access <br /> Public Works recommends that the private road be improved to County standards for a fifty (50) foot wide <br /> right-of-way rural residential road.
