-3- <br /> RESPONSE TO APPEAL STATEMENT NO. 2 <br /> The surrounding uses are primarily residential to the east and south. The East Bay Municipal <br /> Utility District(E.B.M.U.D.) owns the parcel to the north,which contains three aqueducts. The <br /> property to the north is zoned General Commercial: The Religious Assembly-Community use <br /> type may be conditionally permitted in the C-G zone with an approved Use Permit application. <br /> The proposed use will not interfere with nor alter the current land uses on adjacent properties. As <br /> a Condition of Approval, the project will be required to provide screening along the perimeter of <br /> the property to the'north, east,and south. Additionally,as a Condition of Approval, design <br /> drawings will be submitted to E.B.M.U.D. for.review. <br /> A noise study dated December 2, 2008 by Bollard Acoustical Consultants and a traffic study <br /> dated September 17, 2008 by Kimley-Horn Associates, Inc. were performed. Daily prayers will <br /> consist of five masses throughout the day that range from 15 to 30 minutes with an expected <br /> maximum attendance of 25 people: The Friday prayer service begins at 1:00 p.m. and lasts thirty <br /> minutes.' The Friday prayer service anticipates a maximum of 282 people. The classrooms will <br /> i <br /> operate on Sundays for-religious study from 2:00 p.m. to 4:00 p.m., and the applicant anticipates <br /> a maximum attendance of 40 children. The noise study concluded no exterior noise mitigation <br /> was recommended for the project since no outdoor activity area or outdoor call to prayer is <br /> proposed and the project is not expected to significantly affect the existing or future noise <br /> environment in the surrounding community. The study also concluded the developer shall install <br /> sound transmission class 35 or higher exterior windows and doors at the south and west facing <br /> building facades and mechanical ventilation systems shall also be included in the design to <br /> satisfy the 45 dBL interior noise exposure limit. As a Condition of Approval, the applicant will <br /> be required to include the window upgrades and mechanical ventilation systems. <br /> I <br /> The traffic study determined the highest level of traffic generated by the religious assembly will <br /> be on Fridays between 1:00 p.m. and,1:30 p.m. The traffic study recommended a narrow, raised <br /> median island should be installed along the entrance driveway to prohibit cross-movements of <br /> the first parking aisle across the main entrance aisle. Additionally,the traffic study <br /> recommended roadside vegetation be removed and a"No-Parking"zone be established along the <br /> proposed project's East Frontage Road frontage to preserve adequate stopping sight distance at <br /> the proposed driveway intersection. The raised median was not required by the Department of <br /> Public Works as the applicant redesigned their ingress and egress driveway. Additionally, the <br /> recommendation to remove roadside vegetation was not included in the Conditions of Approval <br /> because a ten foot wide landscaped strip is required along adjacent streets pursuant to, <br /> Development Title Section 1020.7. The Department of Public Works has determined that these <br /> two recommendations could be eliminated because the impacts from traffic would still be less <br /> than significant. The Department of Public Works has included the "No-Parking"zone as a . <br /> recommended Condition of Approval: Therefore, the project will not conflict with existing land <br /> uses because mitigation measures that reduce the impacts to less than significant have been <br /> incorporated into the Conditions of Approval. <br />
