-4- <br /> APPEAL STATEMENT NO. 3 <br /> "That the center has inadequate septic system for the usage." <br /> RESPONSE TO APPEAL STATEMENT NO. 3 <br /> The Morada Area Association submitted a report by Bonneau Dickson,P.E.,dated November 15, <br /> 2008 expressing concerns regarding the wastewater system and inadequacies of the soil suitability <br /> study prepared by Chesney Consulting dated July 11, 2008. The Dickson report calculated <br /> wastewater flow based on 800 people and noted there are twenty worshippers per shift,not per day <br /> as mentioned in the original soil suitability study conducted by Chesney Consulting. The <br /> Environmental Health Department reviewed the report and received an addendum prepared by <br /> Chesney Consulting dated December 15,2008 to the original soil suitability/nitrate loading study <br /> incorporating the modified calculation of 20 worshippers per shift and not day. However,the <br /> maximum attendance remained at 295 people as the applicant confirmed there would be a <br /> maximum attendance of 282 people at the religious assembly. The soil suitability/nitrate loading <br /> study with the addendum did not require any significant changes to the septic system from the <br /> original maximum capacity. <br /> APPEAL STATEMENT NO. 4 <br /> "That issues concerning water; septic, parking, lighting,traffic, air quality, and aesthetics were <br /> not properly considered and require an Environmental Impact Report." <br /> RESPONSE TO APPEAL STATEMENT NO. 4 <br /> The septic system and water well will be constructed under permit and inspection of the <br /> Environmental Health Department. The applicant will be required to provide 94 parking spaces. <br /> The applicant is proposing 94 parking spaces which meets the minimum parking requirements. <br /> As a Condition of Approval, any lighting shall be designed to confine direct rays to the premises. <br /> To mitigate for traffic impacts, a traffic study was performed and as a Condition of Approval, a <br /> "No-Parking"zone shall be established along the project frontage. The applicant is subject to San <br /> Joaquin Valley Air Pollution Control District's Rule 9510 to reduce the impacts of growth in <br /> emissions from all new development. An air impact assessment application was filed and <br /> deemed complete by the district on November 18, 2008. The project site is not along a scenic <br /> corridor. Conditions of approval regarding landscaping, including requiring all areas not used <br /> for buildings,parking, driveways, walkways, approved outdoor storage areas, or other permanent <br /> facilities to be landscaped and regarding lighting, including confining direct rays to the premises, . <br /> will ensure the project site is aesthetically pleasing. The Initial Study and Conditions of Approval <br /> adequately addressed these issues and it has been determined that an Environmental Impact Report <br />
