-4-
APPEAL STATEMENT NO. 3
"That the center has inadequate septic system for the usage."
RESPONSE TO APPEAL STATEMENT NO. 3
The Morada Area Association submitted a report by Bonneau Dickson,P.E.,dated November 15,
2008 expressing concerns regarding the wastewater system and inadequacies of the soil suitability
study prepared by Chesney Consulting dated July 11, 2008. The Dickson report calculated
wastewater flow based on 800 people and noted there are twenty worshippers per shift, not per day
as mentioned in the original soil suitability study conducted by Chesney Consulting. The
Environmental Health Department reviewed the report and received an addendum prepared by
Chesney Consulting dated December 15,2008 to the original soil suitability/nitrate loading study
incorporating the modified calculation of 20 worshippers per shift and not day. However, the
maximum attendance remained at 295 people as the applicant confirmed there would be a
maximum attendance of 282 people at the religious assembly. The soil suitability/nitrate loading
study with the addendum did not require any significant changes to the septic system from the
original maximum capacity.
APPEAL STATEMENT NO. 4
"That issues concerning water; septic, parking, lighting, traffic, air quality, and aesthetics were
not properly considered and require an Environmental Impact Report."
RESPONSE TO APPEAL STATEMENT NO. 4
The septic system and water well will be constructed under permit and inspection of the
Environmental Health Department. The applicant will be required to provide 94 parking spaces.
The applicant is proposing 94 parking spaces which meets the minimum parking requirements.
As a Condition of Approval, any lighting shall be designed to confine direct rays to the premises.
To mitigate for traffic impacts, a traffic study was performed and as a Condition of Approval, a
"No-Parking"zone shall be established along the project frontage. The applicant is subject to San
Joaquin Valley Air Pollution Control District's Rule 9510 to reduce the impacts of growth in
emissions from all new development. An air impact assessment application was filed and
deemed complete by the district on November 18, 2008. The project site is not along a scenic
corridor. Conditions of approval regarding landscaping, including requiring all areas not used
for buildings, parking, driveways, walkways, approved outdoor storage areas, or other permanent
facilities to be landscaped and regarding lighting, including confining direct rays to the premises, .
will ensure the project site is aesthetically pleasing. The Initial Study and Conditions of Approval
adequately addressed these issues and it has been determined that an Environmental Impact Report
