Rodney Estrada, Environmental Health, said he stands behind the nitrate loading study presented by Don <br /> Chesney. <br /> Jane Stewart said she has no problem with the church. Her concern is with the size of the building and the <br /> septic system. This lot size is too small. She said the easement next to EBMUD is not wide enough. She <br /> is concerned about how close the septic system is to the wells. Also, she is concerned about the tree <br /> replacement ratio. <br /> Richard Schaffer asked the Commission to deny the project. An Environmental Impact Report should be <br /> prepared because of traffic, noise, truck parking impacts, and septic problems. <br /> William Fields said he supported the previous speakers in opposition. <br /> REBUTTAL: <br /> Howard Seligman said the opposition by Mr. Schaffer did not present any credible information. He said the <br /> Sikhs do the truck driving and not the Muslims present tonight. There will be no overnight parking. There <br /> will be religious education on the weekend with a small number of students. <br /> PUBLIC HEARING CLOSED: <br /> Commissioner Gibson said he can make the findings. <br /> Commissioner Morri said he can also make the findings. <br /> Commissioner Nickerson said he is in favor of the project. <br /> Commissioner Carter;said she can make the findings and is in favor of the project. <br /> Commissioner Deven'cenzi said he can make the findings. <br /> MOTION: <br /> It was moved, seconded (Morri/Carter), and passed by a unanimous roll call vote (5-0)to: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit No. PA-0800108 with the Findings and Conditions of Approval contained in the <br /> staff report, with the addition of Community Development Department Condition 1.(f)(3), the revision of <br /> Condition 1.(k), and the addition of Public Works Condition 3.p., as follows: <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT <br /> (f)(3) No overnight truck parking shall be allowed on the site. <br /> (k) SIGNS: Sign details shall be consistent with Chapter 9-1710 of the Development Title and <br /> be included on the Site Plan.
