Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit No. PA-03-318 with the Findings and Conditions of Approval contained in <br /> the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any <br /> applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the proposed use is consistent with the RIR (Rural <br /> Residential) designation of the General Plan. Additionally, the Public Services - Essential <br /> use type may be conditionally permitted in the R-R zone with an approved Use Permit <br /> application. The proposed fire station presents no significant General Plan policy issues, <br /> and there are no County Master, Specific, or Special Purpose Plans affecting the site. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> �. proposed roadways. <br /> • This finding can be made because the site has public road frontage on a portion of the State <br /> Route 99 East Frontage Road and a portion of Morada Lane. Despite the access controlled <br /> area imposed by Caltrans on the State Route 99 Frontage Road,there is still enough area <br /> that is unrestricted for driveway access. Morada Estates Municipal District 19 will provide <br /> water and storm drainage. Sanitary sewer will be provided by a septic system that will be <br /> installed under permit from the Environmental Health Department. Although there is a <br /> conceptual interchange improvement design under consideration for the Morada <br /> Lane/State Route 99 interchange that would result in the realignment of the roadways <br /> through the property,the proposed location of the fire station will not be affected. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the site is large enough at 3.12 acres to accommodate the <br /> proposed use and can conform to all applicable Development Title regulations and <br /> requirements. Even if the proposed conceptual realignment occurs, the remaining property <br /> will still be large enough to accommodate the proposed use. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because the Initial Study prepared for the fire station found that <br /> the project would not result in any significant,adverse environmental impacts. <br /> San Joaquin County PA-03-318\Canepa <br /> Community Development Page 4 <br />
