CONDITIONS OF APPROVAL <br /> PA-1000099 <br /> California Water Service <br /> Use Permit Application No. PA-1000099 was approved by the San Joaquin County Planning <br /> Commission on July 1, 2010. The effective date of approval is July 11, 2010. This approval will <br /> expire on January 10, 2012, which is 18 months from the effective date of approval, unless (1) all <br /> Conditions of Approval have been complied with, (2) all necessary building permits have been <br /> secured and remain in force, and (3) all necessary permits from other agencies have been secured <br /> and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establisfiment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Contact Staff. Kevin Swanson, [209]468-9653) <br /> a. BUILDING PERMIT: Submit an "APPLICATION-COMMERCIAL BUILDING PERMIT'. The Site <br /> Plan required as a part of the building permit must be prepared by a registered civil engineer or <br /> licensed architect. This Plan must show drainage, driveway access details including gates, on-site <br /> parking, landscaping, signs, existing and proposed utility services, and grading (refer to the "SITE <br /> PLAN CHECK LIST" for details). A fee is required for the Site Plan review. (Development Title <br /> Section 9-884) <br /> b. APPROVED USE: This approval is to construct an 85-foot in height monopole communications <br /> tower and a 900 square foot enclosed fence equipment leased area as shown on the site plan dated <br /> May 3, 2010." (Use Type: Communication Services-Type II). <br /> c. SETBACKS:-The structure shall comply with the following setback requirements: <br /> (1) The proposed tower and accompanying equipment shelter shall be set back a minimum of <br /> twenty (20) feet from the front property line, five (5) feet from the side property line, and fifteen <br /> (15)feet from the rear property line. (Development Title Table 9-310.3) <br /> (2) New freestanding support structures shall be located a distance equal to at least the height of <br /> the said structure from residential structures on adjoining properties. (Development Title Section <br /> 9-1065.4[d]) <br /> d. MAINTENANCE OF FACILITIES: All freestanding structures, antennas, and supporting equipment <br /> associated with wireless telecommunication shall be maintained in good condition by the provider of <br /> the telecommunication facility and, whenever necessary, repaired or replaced. REMOVAL OF FACILITIES: Freestanding structures, antennas, and supporting equipment <br /> associated with wireless telecommunication shall be removed by the provider of such facilities and <br /> the site restored to its pre-construction state if said facilities have not been operational or used for a <br /> period of six (6) consecutive months. Removal and site restoration shall be completed within ninety <br /> (90) days of the end of said six(6)month period.
