may be erected or added to, nor any tree planted or allowed to grow, to a height which <br /> would be greater than the imaginary surface established in Section 9-1610.2. Whenever <br /> and wherever any of the imaginary surfaces overlap, the most restrictive requirement <br /> shall govern and control. The applicant will be required to meet this requirement as a <br /> condition of approval for the project. <br /> Communication Tower Location <br /> Development Title Section 9-1065.5(a) states that if use of an existing structure or <br /> building on publicly owned or controlled property, or if collocation on an existing wireless <br /> telecommunication facility is not being proposed, the applicant shall provide information <br /> and any other documentation required by the Review Authority explaining why use of <br /> such existing structures or buildings is not feasible or desirable. The applicant has been <br /> informed of this requirement and will be submitting the required documentation at the <br /> June 9, 2010 Development Committee meeting. <br /> This application is tentatively scheduled to be heard by the Planning Commission on <br /> July 1, 2010. The Community Development Department has reviewed Use Permit <br /> application No. PA-1000099 and will be recommending that the Planning Commission <br /> approve the application subject to the following conditions of approval: <br /> Use Permit Application No. PA-1000099 was approved by the Planning Commission <br /> on. The effective date of approval is. This approval will expire on,which is 18 <br /> months from the effective date of approval, unless (1) all Conditions of Approval <br /> have been complied with, (2) all necessary building permits have been issued and <br /> remain in force, and (3) all necessary permits from other agencies have been issued <br /> and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements <br /> shall be fulfilled prior to the establishment of the use and the issuance of any <br /> building permits. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Contact Staff: Kevin Swanson, [209] <br /> 468-9653) <br /> a. BUILDING PERMIT: Submit an "APPLICATION-COMMERCIAL BUILDING <br /> PERMIT". The Site Plan required as a part of the building permit must be prepared <br /> by a registered civil engineer or licensed architect. This Plan must show drainage, <br /> driveway access details including gates, on-site parking, landscaping, signs, <br /> existing and proposed utility services, and grading (refer to the "SITE PLAN CHECK <br /> LIST" for details). A fee is required for the Site Plan review. (Development Title <br /> Section 9-884) <br /> b. APPROVED USE: This approval is to construct an 85-foot tall monopole <br /> communications tower as shown on the Site Plan dated May 3, 2010. (Use Type: <br /> Communication Services-Type 11) <br /> c. STORM DRAINAGE: Any additional stormwater drainage created by new <br /> improvements shall be retained on-site. The drainage pattern and corresponding <br /> storm drain improvements shall be shown on the Site Plan Drainage calculations <br /> 2 <br />
