Hazelton Avenue <br /> Stockton, CA 95205 <br /> FEB 81978 <br /> Gentlemen: <br /> EIR-78-6/U-78-24 SAN JOAQUIN COUNTY <br /> ROBERTS ISLAND MARINA (Cort) PLANNING DEPARTMENT <br /> The Department of Navigation and Ocean Development has reviewed the subject <br /> document and finds the project to be in non-conformance with the following <br /> sections of the Delta Master Recreation Plan's Waterways Use Program: <br /> Section III.C.2.d. (1) (d) requires 300-foot clearance between the <br /> intrusion's maximum extension and the undeveloped opposite bank <br /> at MLLW. The purpose of this criterion is to maintain a 100-foot <br /> unrestricted navigation channel at a distance of 200 feet from <br /> shoreline structures. (Section 655.2 of the Harbors and Navigation <br /> Code requires a five nautical miles per hour speed limit within <br /> 200 feet of in-water construction occupied by people or boats) . <br /> Section III.C.2.d. (2) (c) limits commercial shoreline developments <br /> to a maximum extension along the shoreline of 350 feet. Section <br /> III.C.2.d. (2) (a) further limits these developments to the minimum <br /> necessary extension.
