Analysis <br /> Background <br /> On February 11, 1999, the Community Development Department received an application for a Site Approval <br /> for a 12-foot by 25-foot, double-faced, outdoor advertising sign. The applicant, Outdoor Systems <br /> Advertising, at that time already had two similar, legal, non-conforming signs in place within the 1,000-foot <br /> distance spacing needed to place another sign, which is required by County Development Title Section 9- <br /> 1710.6[a][4]. At the time of construction of these signs, only a building permit was required, not a Site <br /> Approval. The ordinance reads: "The space between off-premises signs shall be at least one thousand <br /> (1,000)feet on either side of the same street." However, Outdoor Systems, upon applying for the new sign, <br /> explained that their existing signs to the east, on Mr. Parrish's property, would be taken down because Mr. <br /> Parrish had decided to break the lease with Outdoor Systems and conduct business with another sign <br /> company. The existing signs were removed prior to approval of SA-99-13 and SA-99-14. Hence, there was <br /> no conflict regarding the 1,000-foot spacing for the placement of off-premises advertising signs. The <br /> Community Development Department accepted the application and proceeded with the normal processing <br /> of the application. <br /> The Community Development Department processes applications as they are filed on a first come, first <br /> serve basis. Outdoor Systems filed their application prior to Mr. Parrish. In fact, neither Mr. Parrish nor <br /> Obie Media, the sign company with whom he was negotiating a new lease, ever filed an application with the <br /> Community Development Department. <br /> Mr. Parrish's Appeal <br /> Appeal Statement No. 1 <br /> 1 The County accepted an application for a new off-premises advertising sign when two already existed <br /> within a distance of 1,000 feet on the same street. <br /> Response to Appeal Statement No. 1 <br /> Upon applying for the Site Approval, Outdoor Systems, the owner of the signs on Mr. Parrish's property, <br /> informed the Community Development Department that their lease with Mr. Parrish had been terminated <br /> and would remove the sign on the Parrish property, thus allowing them to place a new sign to the north <br /> The sign on the Parrish property was removed during application processing. <br /> Appeal Statement No. 2 <br /> 2.
