The number of people on the subject property does not have an effect on the <br /> surrounding property owners' spraying or farming practices. <br /> The Old River School existed on the site for many years, and the day care facility has operated <br /> on the site for approximately ten years. Staff at the Agricultural Commissioner's office are not <br /> aware of any health problems or formal complaints relating to the application of or exposure to <br /> chemicals during the latter period of time. In acting upon the Use Permit application for the day <br /> care facility in 1984, the Board of Zoning Adjustment considered the potential health risks <br /> associated with the adjacent land uses. Those potential risks were not found to be significant, <br /> and the application was approved. The impact of the expanded facility on the agricultural <br /> practices of surrounding farmers is not expected to be either significant or adverse, due to the <br /> protection offered by the County's Right to Farm Ordinance. <br /> The opposition also stated that the use was more appropriate for an urban setting rather than an <br /> agricultural area. The project, an expansion of a migrant Head Start facility, is a permitted use <br /> in the AG-40 zone and is an agriculturally related use. In fact, it is more closely related to <br /> agriculture than the previously-approved use on the site, a day care facility. <br /> Emergency Services: The issue of distances to emergency services was discussed at the time <br /> Use Permit Application No. U-84-98 was approved. At that time, the proximity to such services <br /> was not found to be excessive, nor were grounds found for denying the project. The requested <br /> expansion of the facility affects the number of children on the site; it does not affect the distance <br /> that must be traveled to reach necessary emergency services. According to the Escalon Fire <br /> Department, estimated response times are as follows: ten to twelve minutes for the fire <br /> department and six minutes for ambulance services. The facility is approximately 15 minutes from <br /> Doctor's Medical Center in Modesto. There have been no changes in these response times, and <br /> staff, therefore, does not find this to be a significant, adverse impact. <br /> Building Code Compliance: One of the letters of opposition stated that the school building was <br /> not earthquake safe and could present a hazard to young children and infants. At the time of <br /> approval, the owner at the time was required by the Building Inspection Division to make a <br /> number of repairs to the old school building. Those repairs were made, and the use was allowed <br /> to be initiated. Because the expansion of the previously approved facility does not involve a <br /> change in the occupancy,the Building Inspection Division will not require additional improvements <br /> beyond those already made. The three new proposed portable classrooms will be required to <br /> meet current State building standards as a part of licensing procedures with the State.
