C. The owner shall grant easements of sufficient width for all District facilities which may exist <br /> on the subject property to serve as a replacement for any prescriptive and/or unrecorded <br /> easements that are present. All existing recorded or newly dedicated District easements <br /> shall be shown on the Parcel Map prior to recordation. <br /> d. If the homesite area is lower than adjacent irrigated property, a permanent berm or ditch <br /> will need to be constructed around the homesite parcel to prevent accidental flooding <br /> from irrigation water. The property owner shall either verify field elevations or submit a <br /> written statement to the District to indicate that the property in question is not subject to <br /> flooding from adjacent irrigated property. <br /> Note: A copy of the letter received from the District in response to the application referral is <br /> attached for your review. <br /> 5. COUNTY COUNSEL: <br /> a. Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, <br /> indemnify, and hold harmless the local agency or its agents, officers, and employees from <br /> any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory <br /> agency, appeal board, or legislative body concerning a subdivision, which action is <br /> brought within the time provided for in Section 66499.37 of the Government Code. <br /> NOTE: On September 11, 1992,the San Joaquin County Community Development Department approved <br /> MS-92-168 subject to the Conditions of Approval listed above. <br /> Conditions of Approval - 3 - MS-92-168 <br />
