Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve a one-year Time Extension for Quarry Excavation Permit No. PA-0500403 with anew <br /> expiration date of March 13, 2008,with the previously approved Findings and Conditions of <br /> Approval contained in the staff report. <br /> Previously Approved Findings <br /> 1. The proposal is for the removal of regionally significant or scarce deposits of mineral resources and <br /> not for removal of prime farm land. <br /> • This finding can be made because the proposed project site has been identified as <br /> having significant deposits of sand by the Department of Conservation (Division of <br /> Mines and Geology) and classified within a Mineral Resource Zone 2(MRZ-2). <br /> Specifically,the site is being mined for sand and gravel materials and will not result in <br /> the removal of prime farmland because the topsoil will be temporarily stockpiled and <br /> used in reclamation back to agriculture. <br /> 2. The proposed reclamation of the property upon completion will leave the property in a condition, <br /> which will allow its reuse. <br /> • The finding can be made because the existing almond trees on the site were removed <br /> due to age and less than average production. Upon final reclamation, the site will <br /> continue to be used for agriculture. Moreover, reclamation proceeds concurrently with <br /> the excavation process. Resident hybrid erosion control seed mix will be utilized, <br /> when necessary, in excavated areas for erosion control prior to orchard planting, as <br /> proposed in the Munn & Perkins Reclamation Plan dated August 12, 2005. <br /> 3. Issuance of the permit shall not be significantly detrimental to the public health, safety, or welfare, or <br /> be injurious to the property or improvements to the vicinity <br /> • This finding can be made because there will be no excavation below the ground water <br /> table, and potable water services are to be provided for employees. Additionally, an <br /> Initial Study prepared for this project indicated traffic and noise impacts would be of a <br /> less than significant level.Also, during the course of excavation, no new buildings or <br /> utility systems are proposed, and no permanent or temporary storage equipment areas <br /> are designated. All excavated sand and gravel will be processed at the processing <br /> plant adjacent to the project site.
