River Road, Escalon
General Plan: A/G & OS/RC Community: None
Zoning: AG-40 APN: 247-220-18 &19
Project Size: 142.58 acres Parcel Size: 197.31 acres
Water Supply: Well Sewage Disposal: Septic
Storm Drainage: On-site 100-Year Flood: Yes
Williamson Act: No Supervisorial District: 4
Staff: John Funderburg CEQA Determination: Environmental Impact
Report (EIR)
The Community Development Department had previously prepared a Staff Report for the Planning
Commission Meeting on December 1, 2011. As this item was continued from the December 1, 2011 and
January 19, 2012 meetings the Community Development Department has identified necessary revisions
to the previous Staff Report. The previous Staff Report should not be relied on for purposes of
consideration and review of this project.
Project Description
This is a request for a Revisions of Approved Actions application and an Environmental Impact Report to amend
Ordinance Development Requirement No. 4.of a previously approved quarry excavation permit (QX-89-0002) as
follows:
Hours of Operation: With the exception of periods of declared National, State, or County emergency, daily
operations shall be restricted to the period between 5:00 a.m. and 9:00 p.m. The extended hours of 9:00 p.m. to
5:00 a.m. will be permitted only for projects that contain specifications that limit work to nighttime hours The
number of extended nights will not exceed 125 nights per year provided there are no unexpected delays in
construction work Nighttime work will be limited to the asphalt batch plant loaders trucks including a water truck
and scale house. The crushing of rock and excavation activities will not be permitted between the nighttime hours
of 9:00 p.m. and 5:00 a.m.
The Revisions of Approved Actions request will not remove any of the existing previously approved conditions of
approval including the Reclamation Plan.
Certification of the EIR
An Initial Study/Mitigated Negative Declaration (IS/MND) was originally prepared for the proposed Revisions of
Approved Application. However when residents of neighboring properties expressed additional concerns over
noise and odor it was determined that the project had the potential to result in potentially significant, adverse
environmental impacts and an Environmental Impact Report (EIR) was prepared. This EIR is prepared as a
project-level EIR pursuant to CEQA Guidelines Section 15161. This type of EIR focuses on the direct and
reasonably foreseeable indirect changes in the environment resulting from a change in operational hours.
San Joaquin County QX-89-0002/Aggregates Inc.
Community Development Page 1
