D.2. FINDINGS REGARDING IMPACTS ANALYZED IN THE EIR AND DETERMINED TO BE SIGNIFICANT BUT MITIGATED TO LESS THAN SIGNIFICANT This section includes findings for project impacts which are potentially significant, but which are mitigated to a less than significant level with the imposition of mitigation measures. This Commission finds that all potentially significant impacts of this project listed below can and will be substantially lessened or avoided by imposition of mitigation measures. Specific findings of this Commission for each impact are set forth below in this section. No public agency shall approve or cavy out a project for which an EIR has been certified which identifies one or more significant effects unless the public agency makes one or more of the following findings, supported by substantial evidence in the record: • Changes or alterations have been required in, or incorporated into the project which avoid or substantially lessen the significant environmental effect as identified in the final EIR • Such changes or alterations are within the responsibility and jurisdiction of another public agency and not the agency making the finding. Such changes have been adopted by such agency or can and should be adopted by such other agency. • Specific economic, legal, social, technological, or other considerations, including considerations for the provision of employment opportunities for highly trained workers, make infeasible the mitigation measures or project alternatives identified in the final EIR, but specific overriding economic, legal, social, technological, or other benefits of the project outweigh the significant effects on the environment. (Public Resources Code § 21081; CEQA Guidelines § 15091(a)). The County hereby finds that the following potential environmental impacts can and will be mitigated to below a level of significance, with implementation of the mitigation measures recommended in the EIR. Visual and Lichtine Impact 3.1.1 Implementation of the project has the potential to create a new source of substantial light or glare which would adversely affect day or nighttime views in the area (Final EIR,p. 3.1-5). Significance Before Mitigation: Potentially Significant. Facts: Installation of new light sources, for traffic safety or other purposes,has the potential to create glare on E. River Road absent mitigation(Final EIR,p. 3.1-5). 8
